This request <br />was made in conjunction with some concerns voiced over the public notification procedures used during <br />the process for the proposed rezone of property along Canada Road. On January 18,2007, the Planning <br />and Zoning Commission held a workshop where Staff presented an overview of the procedures mandated <br />by current State law and City ordinances. The Planning and Zoning Commission's consensus was that <br />200'ring remains in effect and the posting of a sign on the property shall be required. <br /> <br />Several cities in our area have approached this issue by adopting an ordinance, which defines public <br />hearing notification sign requirements. The applicant, in any case which requires a public hearing, shall <br />post a sign on the property in question. The sign shall not be erected in the road rights-of-way or in a <br />manner that would obstruct vision of motorists or pedestrians. The sign shall be furnished by the City and <br />must be posted at least 15 days prior to the public hearing at the Planning and Zoning Commission and at <br />least 10 days prior to the public hearing at the Zoning Board of Adjustment. The sign shall include <br />information indicating the action proposed and the date, time and place of the public hearing (see sample). <br />All signs erected under this amendment shall be removed by the applicant and returned to the City within <br />10 days after the public hearing. Public notice sign shall be II"x 1 7" for residential and sites less than <br />one-half acre and 24"x36" for sites one-half acre or more. <br /> <br />Staff, with the guidance from the Planning and Zoning Commission, reviewed the proposed amendment <br />to the Zoning Ordinance (Chapter 106). After a public hearing at the February 15, 2007, meeting, the <br />Planning and Zoning Commission, by unanimous vote, recommended an ordinance amendment by adding <br />requirements for on-site posting of public hearing information. <br /> <br />Action Required hv Council: <br /> <br />1.
