§ 11.9 Contractor shall provide Owner with one sepia set and one electronic copy of final marked -up "as built" <br />drawings of each job site in the Project. <br />§ 11.10 All sums due hereunder are payable in La Porte, Harris County Texas. <br />11.11 This Agreement, in its entirety, shall be binding upon all the parties hereto their respective successors heirs <br />executors, administrators or assigns. <br />§ 11.12 Execution of this Agreement shall constitute approval and acceptance of all terms covenants and conditions <br />as modified and contained in the Contract Documents. <br />§ 11.13 By signing this Agreement, the undersigned certifies as follows: "Under Section 231.006, Texas Family <br />Code, the vendor or applicant certifies that the individual or business entity named in the contract bid or application <br />is not ineligible to receive the specified grant, loan or payment and acknowledges that this contract may be <br />terminated and payment may be withheld if this certification is inaccurate. <br />411.14 Enumeration of Parts of the Agreement This Agreement represents the entire and integrated agreement <br />between the Owner and the Contractor and supersedes Aprior negotiations representations or agreements either <br />written or oral. This Agreement may be amended only by written instruction signed by both Owner and Contractor. <br />Any revision, amendment or modification to the Standard Form of this Agreement shall be valid binding and <br />enforceable only if said revision, amendment or modification is made conspicuous by being underlined lined - <br />through, or highlighted in this Agreement signed by Contractor and Owner. This Agreement comprises the <br />documents listed below. <br />§ 11.15 Even if the Work is otherwise in compliance with the Schedule Owner may, at any time unilaterally direct <br />Construction Manager to accelerate the Work, by among other things establishing additional shifts pa ing or <br />authorizing overtime or providing additional equipment In this event Owner's sole liability to construction <br />Manager shall be to pay any shift differential premium or overtime payments to workers of field supervisors <br />actually incur over and above Construction manager's normal times amounts to account for lost efficiency of <br />worker's, and overtime charges for equipment.
