§ 10.2.2 In the event of such termination by the Construction Manager, the amount to be paid to the Construction
<br />Manager under Section 14.1.3 of A201 T14-1997 shall not exceed the amount the Construction Manager would have
<br />been entitled to receive under Sections 10.1.2 and 10.1.3 above, except that the Construction Manager's Fee shall be
<br />calculated as if the Work had been fully completed by the Construction Manager, including a reasonable estimate of
<br />the Cost of the Work for Work not actually completed.
<br />§ 10.3 SUSPENSION
<br />The Work may be suspended by the Owner as provided in Article 14 of the General Conditions of the Contract; in
<br />such case, the Guaranteed Maximum Price, if established, may be increased as provided in Section 14.3.2 of the
<br />General Conditions of the Contract.
<br />ARTICLE 11 OTHER CONDITIONS AND SERVICES
<br />§ 11.1 Notwithstanding anything to the contrary in this Agreement, or in any document forming a part hereof, there
<br />shall be no mandatory arbitration for any dispute arising hereunder.
<br />§ 11.2 The Construction Documents prepared by the Architect, and copies thereof furnished to the Contractor, are for
<br />use solely with respect to this Project. They are not to be used by the Contractor, Subcontractors, Sub -
<br />subcontractors or suppliers on other projects, or for additions to this Project outside the scope of the Work, without
<br />the specific written consent of the Owner or the Architect , as appropriate. The Contractor, Subcontractors, Sub -
<br />subcontractors and suppliers are granted a limited license to use and reproduce applicable portions of the Drawings,
<br />Specifications and other documents prepared by the Architect appropriate to and for use in the execution of their
<br />Work under the Contract Documents.
<br />§ 11.3 Upon Final Completion, Contractor shall certify that the Project has been constructed in compliance with the
<br />Architect's or Engineer's plans, specifications, and construction documents.
<br />§ 11.4 Contractor shall require all construction workers whether Contractor's own forces or the forces of
<br />Contractor's subcontractors, to wear identification tags on the front of their persons during all times that they are on
<br />Owner's property. Such identification tags shall have identification of the construction worker by number or other
<br />identifying medium in a typeface large enough to be seen from eight feet away.
<br />§ 11.5 Contractor shall require all construction workers, whether Contractor's own forces or the forces of
<br />contractor's subcontractors, to park their personal motor vehicles on Owner's property only in the parking place
<br />designated by the Owner's campus principal. Any vehicles not parked in the appropriate locations shall be towed at
<br />the vehicle owner's sole expense.
<br />§ 11.6 Contractor shall follow, and shall require all employees, agents or subcontractors to follow, the tree ordinance
<br />of the municipality in which the Project is located. In addition, if not covered by the municipal tree ordinance,
<br />Contractor shall barricade and protect all trees on the Project, which shall be included in the Cost of the Work.
<br />§ 11.7 Contractor shall require all construction workers, whether contractor's own forces or the forces of
<br />Contractor's subcontractors, while on Owner's property to refrain from the use of tobacco products, drinking
<br />alcoholic beverages, carrying weapons, speaking profane and/or offensive language, or engaging in any interactions
<br />of any nature whatsoever with students and teachers, including talking, touching, staring or otherwise contributing to
<br />a hostile or offensive environment for Owner's students and staff. All areas of campus, other than the defined
<br />construction area, shall be off limits to Contractor's forces, unless their work assignment specifies otherwise.
<br />Failure of an individual to adhere to these standards of conduct shall result in the immediate termination of the
<br />employment of the offending employee from all construction on any of Owner's property. Repeated termination of
<br />Contractor's or Contractor's subcontractor's forces, or one serious infraction, can resulting the immediate
<br />termination of this Agreement by Owner.
<br />§ 11.8 Contractor shall institute a theft deterrent program designed to restrict construction worker access to
<br />properties of Owner that are currently in use, to maintain supervision of Contractor's and Contractor's
<br />subcontractor's forces, and to reimburse those suffering a theft loss which results from Contractor's forces or
<br />Contractor's subcontractor's forces, as charged and determined by the local authorities having jurisdiction.
