For and in consideration of the mutual covenants, obligations, and benefits hereunder, the <br />parties do hereby agree as follows: <br />I. <br />The parties find that the recitations and statements set out above true and correct. <br />II. <br />Morgan's Point, its employees, agents and authorized representatives, expressly including <br />contractors working on behalf of the Port of Houston Authority, is hereby granted the right to <br />enter, improve, construct improvements, and maintain certain improvements as further described <br />herein on that certain public right-of-way known as Donaldson Street, for the purposes of <br />constructing a portion of a public hike and bike trail. <br />The Improvements will consist of a paved surface, approximately 20 feet in width, with <br />associated landscaping, or grass improvements and cutting. Upon completion of the construction <br />by contractors for the Port of Houston Authority, Morgan's Point will maintain the <br />Improvements. La Porte shall have no financial obligations for maintenance of the <br />Improvements, unless caused by damage by city vehicles, employees, or in connecting to La <br />Porte's hike and bike trail improvements. <br />This Agreement shall be perpetual. <br />IV. <br />V. <br />La Porte may connect its internal hike and bike trail system to the Donaldson Street <br />Improvements. <br />
