<br />Sec. 34-167. Authority to enforce article provisions. <br /> <br />The city's Director of Planning, and/or his employees shall administer the removal of vehicles or <br />parts of vehicles from property. The City's Director of Planning and/or his employees, or his <br />authorized agent, or any peace officer, may enter upon private property for the purposes <br />specified in this article to examine vehicles or parts of vehicles, obtain information as to the <br />identity of vehicles, and to remove or cause the removal of a vehicle or parts of vehicles declared <br />to be a nuisance pursuant to this article. The municipal court of the city shall have authority to <br />issue all orders necessary to enforce such article. <br /> <br />Sec. 34-168. Location or presence within city deemed public nuisance; exceptions. <br /> <br />(a) The location or presence of any junked '/ehicle on any lot, tract, parcel of land or <br />portion thereof, occupied or unoccupied, improyed or unimproyed, within the city <br />shall be deemed a public nuisance, and it shall be unlav,ful for any person to cause or <br />maintain such public nnisance by wrecking, dismantling, rendering inoperable, <br />abandoning or discarding his vehicle on the property of another or to suffer, permit or <br />allow such vehicle to be placed, located, maintained or exist upon his o'.vn real <br />property; provided, however that this section shall not apply to a vehicle or part of a <br />vehicle that is: <br /> <br />(1) Completely enclosed within a building in a lawful manner '.vhere it is not <br />'/isible from the street or other public or pri'/ate property; or <br />(2) Stored or parked in a lawful manner on priyate property in connection v,'ith <br />the business of a licensed vehicle dealer or junkyard, or that is an antique or <br />special interest vehicle stored by a motor vehicle collector on the collector's <br />property, if the vehicle or part and the outdoor storage area, if any, are: <br />a. Maintained in an orderly manner; <br />b. Not a health hazard; and <br />c. Screened from ordinary public view by appropriate means, including a <br />fence, rapidly growing trees or shrubbery. <br /> <br />(b) The relocation of a junked vehicle that is subject to a proceeding for the abatement <br />and removal of said junked vehicle under this Code, does not constitute an abatement <br />of said junked '/ehicle nnisance, proyided that said junked vehicle constitutes a <br />public nuisance at the new location. <br /> <br />(a) A junked vehicle, including a part of a junked vehicle, that is located on private or <br />public property, occupied or unoccupied, improved or unimproved, and is visible at <br />any time of the year from a public place, public right-of-way, or private property is <br />detrimental to the safety and welfare of the general public, tends to reduce the value <br />of private property, invites vandalism, creates a fire hazard, is an attractive nuisance <br /> <br />Page 2 of5 <br />
