TEXAS 77002. <br />(713) 228-1463 <br />June 12, 1978 <br />The Honorable Mayor of the <br />City of LaPorte <br />and City Commission <br />P.O. Box 1115 <br />LaPorte, Texas 77571 <br />RE: Lots 4 and 5 in Block 2, Sylvan Beach Subdivision; request <br />for variance <br />Gentlemen: <br />I represent the Estate of G. E. Bauer, Deceased, and his surviving wife, Dorris <br />Bauer who are the owners of the above described real property situated in the <br />city of LaPorte. This property is also known as 208 Cypress Street and 220 <br />Cypress Street. Mrs. Bauer's daughter and her husband are presently residing on <br />the property. <br />In order to prevent people from parking on the front part of their property and <br />fran throwing trash on the property and to better define the approximate boundaries <br />of the property Mrs. Bauer contracted with Montgomery Ward to install a four <br />foot chain link fence around the property including the front property. <br />Mrs. Bauer was not aware of any ordinance that would prohibit her from placing <br />this fence on her property. After construction had begun and all of the fence <br />posts had been set in concrete she was advised by Mr. A. B. Steckman that the <br />portion of fence across the front of the property was in violation of an ordinance. <br />I am enclosing two pictures of the subject property with the fence nearly oompleted. <br />That portion of land between the street and fence as shown in the picture is a <br />.city easement so that the fence is totally on the property of the Bauers' and <br />not in any way on the city easement nor is it up next to the street. <br />Mrs. Bauer was given a copy of Page 18 out of the city ordinance regarding <br />certain regulations including those set forth in Article 13-205. I am assuming <br />that these regulations govern this particular subdivision. It is my understanding <br />that this is a very old subdivision and the Bauers have owned these two lots for <br />quite a number of years. The fence that has been placed on the property by the <br />Bauers is certainly in keeping with the general scheme and development of this <br />subdivision as a residential area. <br />Mrs. Bauer has advised me that there are fences surrounding the following properties <br />in the same subdivision including the front of said properties, to -wit: <br />
