y • ~ • <br />• <br />ORDINANCH NO. <br />AN ORDINANCE OF THE CITY OF PLANO, TEXAS, AMENDING SECTION <br />4-17 OF CHAPTER 4, ANIMALS AND FOWL, OF THE CODE OF <br />ORDINANCES OF THE CITY, PROVIDING REGUI;ATIONS FOR THE <br />KEEPING OF POTBELLIED PIGS WITHIN THE CITY; PROVIDING A <br />REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A <br />PENALTY CLAUSE, AND AN EFFECTIVE DATE. <br />WBEAEA~, the present Code of Ordinances of the City of <br />Plano restricts the areas within the City in which residents <br />L <br />may keep potbellied pigs, which are defined as livestock; <br />and <br />A$EREAB, the City Council recognizes that potbellied <br />pigs az~e desired and considered as pets to many inhabitants <br />oP the City, and, therefore, Por the benefit, comfort and <br />safety of all citizens o! Plano, deems it advisable to <br />provide regulations regarding the keeping oP potbellied pigs <br />in the City; <br />NOiI, TBEREFORH, BE IT ORDAINED HY T8E CITY COIINCZL OP <br />• THE CITY OF PLANO, TEXAS, THAT: <br />Section =. Section 4-17, Livestock, of Chapter 4, <br />Animals and Fowl, of the Code of Ordinances of the City of <br />Plano, Texas, is hereby revised and amended to read in its <br />entirety as follows: <br />"Sec. ~-17. Livestock. <br />(a) No person shall engage in keeping livestock within <br />the corporate limits of the City, except in districts zoned <br />by the Comprehensive Zoning Ordinance of~the City as Estate <br />Development-1, Estate Development-2, or Agriculture. No <br />more than two (2) animals defined as being livestock may be <br />kept in any Estate Development-1 District. No mare than one <br />(i) anime~l defined as livestock may be kept in any Estate <br />Development-2 District. No more than one (1) animal defined <br />as being livestock per four thousand five hundred (4,500) <br />square Peet of available space may be kept fn any <br />agricultural zoning district. <br />(b) It is an affirmative defense to subsection (a) <br />above that the animal is a potbellied pig, which meets with <br />the requirements set forth in subsection (c) below. <br />(c) Requirements for keeping potbellied pigs: <br />• (1) It shall be unlawful for any person to keep, <br />harbor, or raise more than two (2) adult <br />potbellied pigs in any one (1) location <br />' within the City.
