• <br />r: <br />Conclusion <br /> <br />Development Ordinance Section 4.04B requires that following its review of a Final Plat, the <br />Commission take one of the following actions. <br />1. Approve the Final Plat as flied; <br />2. Disapprove the Final Plat as filed, provided the reasons for such disapproval <br />are stated in writing and a copy of the statement is signed by the Chairman <br />of the Planning Commission. <br />• <br />Commission action shall be noted on three (3) copies of the Final Plat, which shall be <br />distributed to the developer, Department, and official files of the Commission. <br />Normally, approval of a Final Plat would authorize the developer to begin construction of <br />subdivision improvements. Recordation would take place once the improvements were <br />completed and accepted by the City and franchise utility companies. <br />In this case, since all infrastructure is already in place, approval will allow the plat to be <br />released for recordation. Once recorded, construction of homes can begin. If disapproved, <br />the developer will be required to file a new Final Plat. <br />Staff finds this plat to comply with applicable ordinance requirements of the City of La <br />Porte. We, therefore, recommend that it be approved subject only to the following <br />conditions. Prior to being released for recordation, <br />Building setback lines be plotted. <br />The phrase "the City of La. Porte, any citizen thereof' be removed from <br />paragraph #4 of the Owner's Acknowledgement. <br />• <br />
