There has been no Commission action in this area; however, <br />adjacent developments do not have sidewalks. In keeping with this <br />standard, Commission may not wish to include a sidewalk for this <br />development. <br />Conclusion: Staff finds the requested replat of Part Commercial Reserve "E", "Not Part <br />of Subdivision", Fairmont Park East, Section I satisfies applicable provisions <br />of State Law and City Ordinance. <br />We, therefore, recommend Commission approval with the condition that the <br />replat not be released for recordation until the following items have been <br />satisfied: <br />1. As required by Section 4.07, language on the plat shall be amended as <br />follows: <br />a) Delete paragraph (4) -does not apply. <br />b) Delete Paragraph (5) -does not apply. <br />c) Add the name of the county on the notary acknowledgements. <br />d) Add the Recorded Map Return Agreement Certificate as per <br />Appendix D, Enclosure 7, Pg. 16. <br />2. All signatures required on the plat are obtained prior to formal <br />recordation. <br />3. The applicant must pay a $50.00 fee to the City for the county filing of <br />the 24 X 36" plat. <br />4. The applicant must pay public hearing costs of $41.40. <br />
