Realty Advisors, L.L.C. <br />Reauested For: 18.12 Acres out of a 33.16 Acre Tract, being all of Outlots 34, 35, 46, 47, 54 <br />and 55 and Part of Outlots 36, 45, 66 and 67, La Porte, Volume 59, Page <br />313, H.C.D.R., situated in the Richard Pearsall Survey, Abstract 625, Harris <br />County, Texas <br />Present Zoning: High Density Residential (R-3) and Low Density Residential (R-1) <br />Reauested Use: Residential Subdivision <br />Background: The proposed Spencer Landing is a major subdivision that is located on the <br />north side of Spencer Highway in the 11,400-11,500 Block of Spencer <br />Highway. (See Exhibit A) The Commission approved the General Plan for <br />this subdivision during their April 17, 1997 meeting. <br />Analysis: By approval of the Section II Final Plat, payment of the $15,575.00 <br />remaining balance of money in lieu of parkland fees will need to be made. <br />As noted in previous reports, this figure was calculated on a $175.00 per lot <br />basis and the total for the entire subdivision was $24,500.00. With the <br />development of Section I, payment of the original $8,925.00 fee was made <br />by the developer. <br />Upon submittal of the Section II Final Plat, the developer will be <br />responsible for providing covenants or deed restrictions.. Specific terms <br />of the covenants should include the following: <br />• Clear responsibility for maintenance of landscaping, screening, <br />fencing and undeveloped portions of property. <br />• Clear responsibility for maintenance of all stormwater drainage <br />systems located on site including swales, channels and detention <br />facilities. <br />• The funding mechanism to be used to provide for maintenance items <br />specified by covenants. <br />• A clear statement specifying the parties responsible for administration <br />and enforcement of convenants. <br />
