• <br />11 <br />Staff Report Bayou Forest Apartments August 19,1999 <br />Location: A 107 acres tract out of the W.P.Han is Survey, Abstract No. A-30, <br />Harris County, Texas. The property is located at the corner of <br />Hwy. 146 and McCabe Road (Exhibit A). <br />Background: The tract in question became part of the City of La Porte in <br />December 1988. It was taken into the City as part of the <br />annexation of the former Bayshore Municipal Utility District <br />(Ordinance 1626). Subsequent to annexation, the City updated and <br />amended the Comprehensive Plan in order to apply it to the newly <br />incorporated areas. As a part of this process, zoning classification <br />was assigned to the various tracts and subdivision (Ordinance <br />1501-J). The zoning designation assigned to the tract in question <br />was P.U.D. <br />On July 15, 1993, La Porte Planning and Zoning Commission <br />considered approval of rezone request #R93-001 for 100.6034 <br />acres to Low Density Residential (R-1) and the remaining 6.7526 <br />acres to Neighborhood Commercial (NC). The Commission <br />recommended approval to City Council. <br />On August 9, 1993, City Council passed and approved Ordinance <br />1501-Q which authorized the R-1 and NC zoning of the property. <br />These designations were found to be compatible with the goals & <br />objectives of the Comprehensive Plan. The rezoning was requested <br />in conjunction with the submittal of a General Plan for development <br />of a single-family subdivision and a small commercial area. <br />On April 21, 1994, the Planning and Zoning Commission was again <br />asked to look at this tract. The property owners had re-evaluated <br />their development options and asked to rezone of a portion of R-1 <br />property (17 acres) to P.U.D. which opens the possibility of placing <br />Mid to Higher Density Residential (apartments). <br />The rezone request #R94-001 asked that a 17 acres tract be rezoned <br />from R-1 to P.U.D. The rest of the tract would be composed of 83.59 <br />acres zoned R-1 and 6.7526 acres zoned NC. The Commission <br />recommended approval to the City Council. On May 23, 1994, City <br />Council passed and approved Ordinance 1501-R, which authorized <br />the P.U.D. zoning of new 17 acres tract. <br />
