The applicant, through a Sewer Service Agreement, <br />should commit to paying for the lift station improvements needed to <br />provide sewer service to his project and be responsible for the on-site <br />improvements needed to serve this project. The City has prepared a plan <br />for providing sewer service to unserved areas of southeast La Porte. The <br />plan calls for a regional lift station to be constructed in, the vicinity of <br />McCabe Road and Taylor Bayou. This General Plan should show a 50' <br />x 50' lift station site adjacent to McCabe Road and Taylor Bayou. The <br />dedication of this site may be negotiated in the Sewer Service <br />Agreement. <br />. Drainage - this property lies within the Taylor Bayou watershed. There <br />are not sufficient channel improvements ta directly receive stann water <br />runoff from this project. The simplest solution would be for the <br />applicant to provide stonn water detention within his project. <br /> <br />Recommendation: Based on items discussed under Analysis, staff recommends approval of the <br />General Plan covering 107 acres and the Special Conditional Use Pennit <br />covering 16.2 acres with the following conditions: <br /> <br />1. The overall density of the project (phases 1 and 2) shall not exceed <br />19.7 dwelling units per acre. <br /> <br />2. The applicant shall enter into Sewer Service Agreement and commit <br />to paying for lift station upgrades related ta this development project. <br /> <br />3. This action in no way commits the City to any maintenance <br />responsibilities for the 75.7 acre Conservation Easement. <br /> <br />A recommendation from the Commission on this Special Conditional Use <br />Pennit will be forwarded to City Council for final consideration. If approved <br />, by Council, the applicant would be authorized to proceed with submittal of a <br />Major Development Site Plan for Phase One. The Phase Two development <br />as proposed, will require the applicant to request a zone change from the <br />current R-1 to PUD and then submit an application for a Special Conditional <br />Use Permit. Approval of Phase 1 in no way demonstrates any level of <br />approval for the future Phase 2. <br />
