<br />.', <br /> <br />. <br /> <br />EX,hibitE <br /> <br />, , <br />DECLARATION OF COVENANTS, RESTRICTIONS, <br />'EASEMENTS, CHARGES AND LIENS FOR <br /> <br />TEXAS lMPORTIEXPORT PARK <br /> <br />This Declaration of Covenants, Restrictions, Easements, Charges and Liens for <br />(hereinafter referred to as this "Declaration"), made 'as the _ day of <br />. - (hereinafter <br />referred to as "Declarant") and the persons or entities whose names appear hereon or on any <br />counterpart hereof (individually, the "Owner"; collectively, the "Owners"). <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, Texas ImportlExport Park is a-business subdivision located in Harris <br />County, Texas, according to the map or plat thereof recorded in Volume --J Page of the <br />Harris County Deed Records (the "Subdivision'.'); and <br /> <br />WHEREAS, Declarant is the fee simple owner of that certain real property within the <br />Development more particularly described on Exhibit :B..: attached hereto and incorporated herein <br />. by reference, and the Owners are the fee simple owners of that certain real property within the <br />Development more particularly described on Exhibit ::.B...:: attached hereto and incorporated <br />herein by reference (the real property specifically owned by each Owner having such Owner's <br />name on the legal description for such real property attached hereto as Exhibit :B..:) (the real . <br />property Qescribed in attached, Exhibit ~ and Exhibit ::.B...:: collectively referred to hereinafter ' , <br />as the "Development"); and <br /> <br />WHEREAS, two (2) - of the parcels out of the property described on Exhibit :....B: have <br />been improved to provide certain flood water drainage, retention, and detention facilities for the <br />,Development, said parcels being more particul~rly described on Exhibit" B" attached hereto and <br />incorporated herein by reference (the "Flood Con~rol F~cilities"); and <br /> <br />WHEREA~, Declarant and the Owners desire to provide for the preservation of the ' <br />Development and for the maintenance of the Common Areas (as hereinafter defined); and, to this <br />end, desire to subject the real property described in Article II hereof to the covenants, restrictions, <br />easements, charges and liens hereinafter set forth, each and all of which are for the benefit of the <br />Development, each Owner and the Declarant; and <br /> <br />WHEREAS, Declarant and the Owners agree that it is desirable for the efficient <br />preservation of the values and amenities in the Development to create an entity which will own <br /> <br />1 <br />
