Port Crossing, a mixed commercial/retail and business industrial development, is to be located along South <br />16th Street (Powell Road) between State Highway 146 and Union Pacific Railroad within Planned Unit <br />Development (PUD) zone. <br />. The property is in the vicinity of major industrial developments, Bayport Industrial District, Bayshore <br />Industrial, Inc. and located between State Highway 146 and Union Pacific Railroad (UPRR). <br />. Proposed Business Park will be developed in phases. <br />. The First Phase, Section 1, will be developed to the West of Powell Road just south of the former <br />Boncosky Trucking terminal at 1706 S. 16th Street. <br />. City Council previously approved Special Conditional Use Permit #SCU05-003 for Port Crossing <br />(formerly Texas Import/Export Park). <br />. Further developments will be warehouse, distribution center equipped with UPRR access to the west, and <br />several other industriaVcommercial developments within the park. <br />. The area is earmarked for industrial uses in the Land Use Plan. <br />. Public infrastructure needs to be installed for the overall business park as prescribed by the Development <br />Agreement. Coordination with Harris County, Harris County Flood Control District, and TxDOT shall be <br />required in this regard. <br />. Final Plat for Port Crossing with construction drawings, covenants, conditions, and restrictions for the <br />proposed park shall require approval by the City. <br /> <br />Recommendation: <br /> <br />Given that we now see some forward movement on the development in general, Staff recommends approval of <br />Special Conditional Use Permit #SCU06-006. If approved, this permit will supersede Special Conditional Use Permit <br />#SCU05-003 and shall be applicable for an overall development in conjunction with the Development Agreement and <br />CCRs. Staff and the developer agree that Development Agreement, and all supporting documents contained therein <br />will be presented in final form and that this SCUP does not go into effect until all elements are considered by the <br />Commission and approved by the City. Should the Commission wish to approve the SCUP in its present format, we <br />recommend the following: <br /> <br />1. This SCUP is not applicable to any other specific development anticipated or proposed by General Plan. <br />2. This SCUP outlines in general terms the proposed Planned Unit Development. The developer recognizes and <br />understands that any future construction or development of the private or public improvements anticipated by <br />this SCUP and the General Plan shall require further submittal and approval of plats, site plans, construction <br />drawings, and building plans. <br />3. Said submittals shall be in accordance with this SCUP, the approved General Plan, Development Agreement, <br />the City of La Porte and specifically Section 106-216 & 217 of the Zoning Ordinance. <br />4. The Developer shall comply with all other applicable laws and ordinances of the City of La Porte and the State <br />of Texas. <br /> <br />Actions required by the Commission: <br /> <br />. Recommend to Council approval of this SCUP with conditions. <br />. Recommend to Council denial of this SCUP. <br />. Recommend tabling this SCUP for further review. <br /> <br />BHtBIT 1 <br />
