Fairmont Parkway, La Porte, TX 77571 <br />www.cLla-porte.tx.u5 <br />Phone: (281) 471-5020 / Fax (281) 842-1868 <br /> <br />MEMORANDUM FOR RECORD <br />April 08, 2008 <br /> <br />TO: Planning and Zoning Commission <br /> <br />FROM: Masood Malik, City Planner <br /> <br />Re: Proposed Amendment to Chapter 106, Section 106-875, Off-Premises Signs <br /> <br />The Zoning Board of Adjustment, at the meeting on February 28, 2008, requested that the <br />Commission/Council review the Section of the Ordinances pertaining to off-premises signs. <br /> <br />BACKGROUND <br /> <br />Attached is the staff report and supporting documents for Appeal of the Enforcement <br />Officer's Decision #A08-001 that were presented to the Zoning Board of Adjustment (ZBOA) <br />on February 28, 2008. This appeal was submitted by SignAd, Ltd. for denial of a permit to <br />erect an off-premises advertising sign within 1,000 ft. of an existing sign along West Main <br />Street (Spencer Highway). The proposed site is located at 1911 W. Main Street near overpass <br />and turn around adjacent to the Union Pacific Railroad (UPRR). Section 106-875 (h) of the <br />Ordinances states: <br /> <br />~ All off-premises freestanding advertising signs shall be spaced in intervals of not less <br />than 1,000 feet. <br /> <br />.--.Ih~_~QPlicant stated that th~~gn is locatc~~css of 1,000 feet fro~ f!l~~tl.l"es!__. <br />sign on the same roadway. While, staff noticed an existing sign is located within 500 feet on <br />the same roadway to the north of Spencer Highway. The City's decision and interpretation of <br />the above section is 1,000 feet radius circle, not linear feet or along the same side ofthe road. <br /> <br />Based on the facts and consideration presented at the meeting, the Board with the vote being <br />4 in favor and 1 opposed upheld the Enforcement Officer's Decision to deny the permit for <br />proposed advertising sign. Currently, the case is in District Court. <br /> <br />ACTION BY THE COMMISSION <br /> <br />1. Consider Public Hearing by next meeting <br />2. Discuss the Issue <br />3. The Commission may elect to: <br />~ Direct Staff to develop a recommendation by next meeting <br />~ Make a Recommendation to City Council after public hearing <br />
