<br />• <br />Request: AP 89-001 <br />L J <br />Type of Request: Appeal of the Enforcing Officer's decision to <br />deny a building permit based on non-compliance <br />with Section 5-700, Table B (front yard <br />setback.~•) of Ordinance 1501. <br />Requested For: 701 South Kansas <br />Leal Description: Lts 1, 2 & 20 ft. of It 3; blk 263; La Porte <br />Tract (see~Exhibit A) <br />Owner: Billy B. Lamar <br />Zoning: R-1, Low Density Residential <br />Back>?round & Analysis: <br />On 1\rovember 16, 1988, P1r. Billy Lamar made'- <br />application for a building per•r;iit for construction <br />• of an eighteen foot by eighteen foot (18' ~ 18") <br />carport to be attached to the front of his house <br />located at 701 South ::ansas Street. P. review of <br />the permit application indicated that as proposed, <br />the carport could not be built. A1r. Lamar was <br />informed of this. <br />N?r. Lamar subsequently requested an appeal of this <br />decision. On January 3,. 1989 t1r. L.arnar's permit <br />application. was forr„ally denied in order for the <br />appea? process to be initiated. <br />This permi'c was c~Fnied based on the proposed <br />car•ports's failure to meet the setback requirements <br />c~ SF~:i.~c~r! 5-700, Table B of City Zoning Ordinance <br />1501 (see Exhibit B). This table specifies a front <br />yard setback of twenty-five (25) feet for single <br />family homes located in residential zoning <br />districts. The garage of hir. Larrar's hone .~.s <br />setback exactly twenty-five (25) feet from tY;e <br />front property line. There is no area forward of <br />this line which may be occupied by a roofed <br />structure. Exhib:~t G indicates the location of the <br />twenty-five (25) foot front setback line on this <br />property. It also indicates the location of A•ir. <br />Lamar's propo:~ec; carport. The entire carport, if <br />® constructed, would clearly encroach into the <br />required setback area and be in violation of the <br />requirements of the City's Zoning Ordinance. <br />
