<br />• Request: AP89-002 <br />Type of Request: Appeal to the Enforcing Officer's decision to <br />deny a building permit for an addition to an <br />existing commercial building. Permit was <br />denied for failure to comply with the <br />requirements of Ordinance ;1501, Section <br />6-500, Table B. <br />Requested For: Garza's Tire & Mechanic Shop <br />318 North 8th St., La Porte, Texas <br />Legal Description: Blk 77, Lots 8 & 9; La Porte Tract (See <br />Exhibit A) <br />Owner: t;oe Garza <br />Zoning: General Commercial (G.C.) <br />Background: <br />On February 16, 1989, Mr. Noe Garza submitted a certified_ <br />site plan (C.S.P.) for review. C.S.P. review and approval is the <br />required first step for obtaining a building permit for <br />• commercial construction. On February 21, 1989, this site plan <br />was reviewed and disapproved (See Exhibit B). Disapproval was <br />primarily based on t}ie pr•or~osed addition's failure to comply with <br />City Zoning and Fire Code requirements. <br />On February 22, 1989, in order to initiate the appeal <br />process, Mr. Garza submitted a building permit application which <br />was denied by the Code Enforcement staff (See Exhibit C). <br />Specific areas cf non-compliance with zoning requirements <br />were as follows. <br />1. Addition would cause maximum allowable G.C. lot coverage <br />of 40~ to be" exceeded by 900 square feet or <br />approximately 10~ (Section 6-500, Table B; See Exhibit <br />D) <br />2. Addition would encroach f9.fteen (15) feet into the <br />required ttaenty (20)~ feet rear set-back area (Section <br />6-500, Table B). <br />3. There is not adequate room on the property to deveicp <br />required parking. As an existing building, the present <br />parking is a given. However, additional parking would <br />be required for any building addition. To comply with <br />current ordinance requirements .all parking spaces and <br />maneuvering room must be contained on premise. <br />
