Lewis <br />Chief Building Official' <br />City of La Porte <br />La Porte, Texas <br /> <br />Dear Sir: <br /> <br />Pursuant to section 11-604 of the City of La Porte Zoning <br />Ordinance 1501, an Appeal is hereby taken to the Board of <br />Adjustment of the denial by Mark S. Lewis of the request of Ms. Jan <br />Stevenson for a building permit to place a manufactured home at 230 <br />Dwire Drive. <br /> <br />On December 31, 1988, Ms. Stevenson was the owner of two <br />residential lots more particularly described as follows: <br /> <br />Lots 8 and 9 in Block 7 in Bay Oaks Subdivision in Harris <br />County, Texas as recorded in Volume 10, Page 9 of the Map <br />Records of said County. <br /> <br />Ms. Stevenson was lawfully using such property as the site for a <br />manufactured home which she occupied as her residence. On such <br />day, such property was annexed by and became a part of the city of <br />La Porte. The city of La Porte assigned to the area in which such <br />property was located a zoning designation of "R-1" pursuant to <br />which no use was permitted except "single family dwellings, <br />detached" and "modular housing on a permanent foundation system" <br />(with certain exceptions not material to this Appeal). After such <br />property was annexed, Ms. Stevenson continued to use such property <br />as the site for a manufactured home until September 18, 1993, when <br />the manufactured home situated upon the property was destroyed by <br />fire and removed. On October 28, 1993, within ninety days after <br />such manufactured home was destroyed by fire and removed, Ms. <br />Stevenson filed her application for a permit to move onto the <br />property a "HOD Code Approved Home where a previous HOD Code Home <br />was consumed by fire". A copy of such Application is attached <br />hereto as "Exhibit A". Such application was denied on October 29, <br />1993. No reason was given for the denial of such application <br />except that such action was in accordance with the Zoning Ordinance <br />1501 of the City of La Porte. <br /> <br />R1124.93 <br /> <br />EXHJBlT B <br />
