• <br />Board of Adjustrcient <br />Meeting of 4/18/96 <br />SE96-001 <br />Page 2 of 4 <br /> <br />Analysis: The Zoning Ordinance defines a special exception as a specified <br />enumerated deviation from Zoning Ordinance requirements. The <br />Boazd is empowered to grant a special exception when it finds the <br />following: <br />Granting the exception will not adversely affect the <br />value, or use of neighboring property. <br />• Granting the exception will not be contrary to the <br />best public interest. <br />Regazding this request, the relief being requested is covered by the <br />terms of the Special Exception Section. <br />• Lots 1 & 2 of Block 717 are corner lots located at <br />North 16th and West Polk. <br />• The front setback of the existing Pfeiffer <br />office/shop building, which is located on the <br />adjacent lots is 10 ft. This is the same setback that <br />is being requested for the proposed building. <br />Based on these factors, the request is eligible to be considered for <br />the exception. The issues tv consider aze impact on neighboring <br />property and the best public interest. The requested front setback <br />reduction should have no impact on use of the existing 16th Street <br />right-of--way. There is adequate separation between property line <br />and edge of pavement to accommodate drainage structures. There <br />is enough separation to provide adequate isolation from traffic on <br />16th Street. The north/south portion of the alley in Block 717 has <br />previously been closed. The alley of the block immediately north <br />of 717 has also been closed. Any extension of future utilities will <br />have to be done in a street right-of-way. Location of the building <br />should not pose a problem. Finally, Polk Street is currently an <br />unimproved right-of--way. In order to provide access to a new <br />pazking lot being constructed also by the applicant, Polk Street is <br />to be improved. The City, together with the applicant, will be <br />able to insure that paving, utility, and drainage improvements aze <br />accomplished in a manner that will prevent conflict as a result of <br />building location. <br />
