The_ <br />first issue concerns. a. complaint by Mr -a Bill'. Stott regardtiffg a � - -- <br />buildin close to Mr. Scott°s g <br />9 property line. You have indicated <br />to me that the building.was recently built without Mr. Blackwell <br />;taking.:out;.a: permit-.froar.the-m4aity_?.:.a€:... La... Porte. You --further.. <br />indicate to- me that since.. the complaint was. made.,.Mr.. Blackwell <br />has.. taken out a permit and. his building- has. been inspected bye the <br />City. Based -on the City's.inspections; Mr. Blackwell has.agreed <br />to: correct.. the only deficiency found: in the building by cutting; <br />back a roof over -hang to establish the building at the required <br />set -back distance from Mr. Scott's property. If all my <br />assumptions are correct, it would seem that the building, when <br />conformed to the Ordinance, would then be eligible for a building. <br />permit'. <br />The second issue raised by your memo regards the concentration of <br />domesticated' livestock on the Blackwell property. You have <br />indicated to me that the concentration is in excess of City of La <br />Porte Zoning Ordinance concentrations, as established in Section <br />10-300 of the Zoning Ordinance:. However, you have also <br />established in your memo that these' domestic livestock have <br />existed on the property prior to the passage of the Zoning <br />Ordinance. <br />You have indicated that the primary use of the property falls <br />under SIC Code Number 0291 (General Farm - Primary Livestock <br />Specialties). If that in fact is the case, and if that property <br />has been so utilized since before the passage of the Zoning - <br />Ordinance, then it is clear that Mr. Blackwell has a legitimate <br />pre-existing, non -conforming use, not subject to current Zoning <br />Ordinance restrictions. <br />Hover, r would caution youto•_ be sure that the SIC Code <br />_ . assigned to.....
