As a result, at least two lots are needed to create. a "buildable" site. <br />Developing moderately sized homes on these lots using our current zoning <br />ordinance requires flexibility. Section 106-191 b (2) c provides the. <br />flexibility/relief for these development challenges. <br />North 1" and W. Tyler are collector streets (60' ROW) in a residential <br />neighborhood. These streets typically are not heavily traveled. In addition, <br />the whole Block 86 is undeveloped except one house along N. 2°d Street at <br />W. Tyler Street. There is a house to the south of the subject property across <br />the street along N. 1st Street. The property shall not: be affected by this <br />change. The overall impact of this proposed change would be minimal: <br />Allowing an exception to the side set back would not create a visual obstacle <br />for motorists and circulation will not be affected. <br />Conclusion: Staff believes the request for a 5' yard exception on the corner lot should be <br />granted. After a careful review .of Section 106-191 b (2) c, this special <br />exception would not be contrary to the public's best interest. In addition, <br />granting the request would not be contrary to the goals and intents of the <br />Comprehensive Plan's redevelopment strategy. <br />Appeals: Asper Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, jointly or severally, aggrieved by any decision of the <br />Board of Adjustment, or any taxpayer, or any officer, department, board or <br />bureau of the city may present to a court of record a petition for a writ of <br />certiorari, as provided by V. T. C.A., Local Government Code - Section <br />211.011, duly verified setting forth that such decision is illegal, in whole or <br />in part spec jdng the grounds of the illegality. Such petition shall be <br />presented to the court within ten days after the filing of the decision in the <br />office ofthe Board ofAdjustment. <br />
