<br />Zoning Board of Adjustment <br />October 21, 2009 <br />#V09-005 & 006 <br />Page 3 of3 <br /> <br />>- Approving requested Variances and allowing the house to be built on the subject <br />property as follows: <br /> <br />#V09-005 - waiving 3' setback adjacent to utility easement in the rear yard. <br />However, no portion of any building including projections of any nature shall <br />encroach into utility easement or vertical projection of the easement boundary. <br /> <br />#V09-006 - allowing 52% lot coverage exceeding 40% and with an additional <br />812 square feet of covered area. <br /> <br />>- Denying Variances and therefore applicant shall comply with the provisions of <br />Section 106-333, Table B, residential area requirements, Code of Ordinances. <br /> <br />Appeals: <br /> <br />As per Section 106-196 of the Code of Ordinances of the City of La Porte: <br />Any person or persons, jointly or severally, aggrieved by any decision of the Board of <br />Adjustment, or any taxpayer, or any officer, department, board or bureau of the city may <br />present to a court of record a petition for a writ of certiorari, as provided by V.T.C.A., <br />Local Government Code Section 211.011, duly verified, setting forth that such decision <br />is illegal, in whole or in part, specifying the grounds of the illegality. Such petition shall <br />be presented to the court within ten days after the filing of the decision in the office of the <br />Board of Adjustment. <br />
