article, regardless of whether such violation is committed by the owner, operator, local contact <br />person, or guest of the owner's short-term rental. Nothing in this article shall be construed to <br />relieve any person or owner of any other applicable requirements of federal, state, or local law, <br />rules, or regulations. Nothing in this Article shall be construed to provide any property owner <br />with the right or privilege to violate any lease, private conditions, covenants, and restrictions <br />applicable to the owner's property that may prohibit the use of such owner's property as a <br />short-term rental as defined in this article. <br />Sec. 22-510. - Permit suspension or revocation; appeal. <br />(a) A short-term rental permit may be revoked or suspended in any case where any of the <br />provisions of this article are violated, or where any owner, permit holder or their guest is <br />engaged in any conduct which violates any of the state laws or city ordinances. The revocation <br />or suspension proceedings shall be as prescribed by subsections (b) and (c) of this section. <br />(b) A short-term rental permit may be revoked or suspended by the City Council after notice <br />and hearing for any cause set forth in this section. <br />(c) The director or their designee shall initiate such proceedings by petition to the city <br />secretary in writing setting forth specifically the grounds for revocation or suspension, and if a <br />suspension, the length of time for which such suspension is requested. A copy of such petition <br />shall be mailed to the last known address of the permit holder. Notice of the time and date of <br />the hearing before City Council, setting forth the specific grounds upon which the director or <br />their designee's petition is based, shall be given in writing by the city secretary through <br />certified mail to the permittee at his last known address at least fifteen (15) days prior to the <br />date set for such hearing. (d) The City Council shall meet on the date specified in the notice <br />mailed to the permit holder, and by a majority vote, determine whether or not such permit shall <br />be revoked or suspended, and such action shall be final and conclusive. <br />Sec. 22-511. - Penalty. <br />Any person who shall violate any provision of this article shall be deemed to be guilty of a <br />misdemeanor and shall upon conviction, shall be fined in an amount not more than $500.00 per <br />offense. Neither allegation nor evidence of a culpable mental state is required for the proof of <br />an offense defined in this section." <br />Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are <br />hereby repealed; provided, however, that such repeal shall be only to the extent of such <br />inconsistency and in all other respects this ordinance shall be cumulative of other ordinances <br />regulating and governing the subject matter covered by this ordinance. <br />Section 4: Should any section or part of this ordinance be held unconstitutional, illegal, or <br />invalid, or the application to any person or circumstance for any reasons thereof ineffective or <br />inapplicable, such unconstitutionality, illegality, invalidity, or ineffectiveness of such section or <br />part shall in no way affect, impair or invalidate the remaining portions thereof; but as to such <br />10 <br />
