<br />THAT WHEREAS, by virtue of a Writ of Execution and Alias Order
<br />of Sale issued out of the District Court of Barris County, Texas,
<br />for the 333rd judicial District, in Cause No~ 94-15098, in favor of
<br />th$ STATE OF TEXAS, COUNTY OF BARRIS, as Plaintiff, and CITY OF LA
<br />PORTE, TEXAS and LA PORTE INDEPENDENT SCBooL DISTRICT, as
<br />Intervenors, against ROBERT BIAZA, JR., Defendant, on a certain
<br />Judgment granted on May 31, 1995, and directed and delivered to the
<br />Constable of Barris County, Texas, commanding said Constable to
<br />leVy upon, seize and sell the land or lots herein described to
<br />satisfy said judgment, the same being for taxes, penalties,
<br />interest and costs due on the hereinafter described lands, together
<br />with interest thereon at the rate of Ten (10%) per cent per annum;
<br />I, BILL BAILEY, Constable of Barris County, Texas, as
<br />aforesaid, did on the 12th day of December, 1996, levy upon and
<br />advertise the said premises as described in said Order of Sale by
<br />giving public notice of the time and place of sale by an
<br />advertisement in the English language, published once a week for
<br />three consecutive weeks prepeding said sale, the first publication
<br />appearing not less than twenty days immediately preceding the date
<br />of sale, beginning on the 17th day o~ December , 1996, in
<br />the DAILY COURT REVIEW, a newspaper published in Barris County,
<br />Texas, stating in said advertisement the authority by virtue of
<br />whiOh said sale was to be made, the time and place of sale" a brief
<br />description of the property to be sold, the number of ac_r~s l.n .the
<br />original survey, its locality in the county, and the name by which
<br />the Oland is generally known, and by deli verying a similar notice to
<br />Defendant, ROBERT BIAZA, JR., on the 1st Tuesday in January, 1997,
<br />between the hours prescribed by law, sold said hereinafter
<br />described property at public outcry in the County of Barris, at the
<br />courthouse door thereof, at which sa1e the property hereinafter

<br />described was struck off to the CITY OF LA PORTE, TEXAS, in trust
<br />

<br />for the use and benefit of itse1f and the STATE OF TEXAS, COUNTY OF
<br />~S, and LA PORTE INDEPEND~ SCHOOL DISTRICT, taxing units in
<br />said cause adjudged to have a.tax lien against said property, and
<br />their successors and assigns, subject, however, to the provisions
<br />hereinafter set forth, for the total sum of the taxes, penalties,
<br />interest, fees and court costs, including costs of sale, as set out
<br />in the above described judgment;
<br />NON, THEREFORE, in consideration of the premises aforesaid and
<br />of the payment of said sum as set out above, receipt of which is
<br />hereby acknowledged, I, BILL BAILEY, Constable of Barris County,
