Box 1115 <br />La Porte, Texas 77571 <br /> <br />Gentlemen: <br /> <br />You have requested my opinion on the City of La Porte's title to its <br />existing sewer plant site, as well as the area which has been desig- <br />nated for expansion of the central sewer plant. <br /> <br />The City of La Porte acquired title to the existing sewer plant site <br />on April 28, 1948, by conveyance from Carl H. Bissell, Individually <br />and as Independent Executor of the Will of Horace D. Kendall, deceased, <br />by Deed recorded in Volume 1766, Page 229, of the Harris County Deed <br />Records. This Deed conveyed all of Block 1126, Town of La Porte, <br />Harris County, Texas, according to the map or plat thereof recorded <br />in Volume 60, Page 112, of the Deed Records of Harris County, Texas. <br />The Grantor in said conveyance reserved the mineral estate. <br /> <br />Thereafter, on January 1, 1974, the City of La Porte acquired by Deed <br />from La Porte Land Company, an adjoining tract of land containing <br />180,480 square feet of area, which Deed is recorded under Harris <br />County Clerk's File No. El18B7B. I have attached to this letter a' <br />copy of my letter to the City of La Porte dated May 21, 1974, which <br />in turn had attached a copy of the City of La Porte's Owner's Title <br />Insurance policy on said tract of land, its Deed, and Corporate <br />Resolution authorizing the execution of the Deed by the Grantor cor- <br />poration. <br /> <br />I also attach copy of the City of La Porte's recorded Deed on Block <br />1126, Town of La Porte. The City of La Porte has, in my opinion, <br />good and marketable title to both tracts of land, subject only to <br />the matters noted in this letter, and in the attachments hereto. <br />The subject tracts have access to South ~tfi Street, a public street <br />in the City of La Porte, as well as access to other platted but <br />presently unopened dedicated public streets in the City of La Porte. <br />There are no easements or rights-of-way on, over, or across these <br />subject tracts. of land. <br />
