Ruff. <br />SPECIAL MEETING <br />LA PORTE CITY COUNCIL <br />~+4AY 12,193$ ~ 9 : 3o A.r~. <br /> <br />to order by ~e Rdayor Sharp w2th the folloxing Aldermen <br />call: C.:d. Agee, P.L. Benson, F.R. Boyle, J.J. RoarY, <br />The Mayor stated that the meeting had been called for the purpose of dis- <br />cussing the case of F.T. Baldwin vs City of La Porte. <br />City Attorney Kiibler outlined to the Council a proposed settlement of the <br />F.T. Baldwin suit against the City and in corformance therexith, Alderman <br />Ages offered in writing and made a motion, second by Alderman Benson, that <br />the folloxing resolution be passed by the Council, to-sat: <br />Be it resolved by the City Council of the city of La torte, Texas: <br />That suit No. B 207705, pending in the District Court, 55th Judicial <br />District of Harris County, Texas, entitled F.T. Baldvrin vs. F.A.Gayls <br />and the City of La Porte, be compromised and settled as follows: <br />1 - That F.T. Baldwin dive the City a proper easement across his <br />Bay Front property for the maintenance and operation of the <br />City Sewer Line, upon condition that the City fix and operate <br />the system so that the man-holes on such property will not <br />overflox; that said suit be dismissed by Baldwin, who shall <br />phi all Court costs incurred therein; <br />2- That the City issue a warrant in the exact amount of the unpaid <br />delinquent taxes owing by F.T. Baldwin to the City and suoh <br />warrant applied to the pa~rr~ent of such taxes and thereafter that <br />-°proper ta:x~r~ceipts Be~isaued:'a~d~.de]:ivered to F.T. Baldwin; <br />that the City issue a xarrant or instrument in favor of F.T. <br />Baldwin for the difference between ~1.~50.00 and the amount of the <br />present unpaid delinquent taxes owing by F.T. Baldwin, which <br />warrant or instrument mall not be payable in money but may be <br />applied only on ad valorem taxes owing by F.T. Baldwin to the <br />Cit-yr in the future; <br />3 -That the 1'~y or and City Secretary be authorized to execute and <br />deliver proper instruments and to do all other things necessary <br />to carry out this settlement and to properly transfer whatever <br />necessary exchanges are needed in the City funds and accounts <br />in carrying out such settlement, <br />and it is so ordered. <br />Carried <br />Business being completed on motion bar Agee, second by Benson ad3ournment <br />was taken. <br />//~ <br />ecretary, City of La orte, Te~.as <br />
