When a properly drawn petition has been duly filed, council shall provide by ordinance for submitting such proposed <br />amendments to a vote of the qualified voters at an election to be held in accordance with the Texas Election Code. If the next <br />regular municipal election is to be held during said period, the submission of said amendment or amendments shall be at such <br />election. Otherwise, a special election shall be called for the purpose. Notice of the election shall be given in accordance with <br />the Texas Election Code. <br />Each amendment submitted shall contain only one subject and shall be printed separately on the ballot, each proposed <br />amendment being followed by designations for the qualified voter to vote for the amendment or against the amendment. <br />Each proposed amendment, if approved by the majority of the qualified voters voting at said election, shall become a part of <br />the Charter. The city secretary shall enter notice into the records of the city declaring the same adopted. <br />b. This section is subject to the provisions V.T.C.A., Local Government Code §§ 9.04 and 9.05, and V.T.C.A., Election <br />Code § 41.001 et seq. <br />Section 26. Each and every provision, paragraph, sentence and clause of this Ordinance has been <br />separately considered and passed by the City Council of the City of La Porte, Texas, and each said <br />provision would have been separately passed without any other provision, and if any provision hereof shall <br />be ineffective, invalid or unconstitutional, for any cause, it shall not impair or affect the remaining portion, <br />or any part thereof, but the valid portion shall be in force just as if it had been passed alone. <br />Section 27. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the <br />extent of such conflict only. <br />Section 28. The City Council officially finds, determines, recites, and declares that a sufficient <br />written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place <br />convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as <br />required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been <br />open to the public as required by law at all times during which this ordinance and the subject matter thereof <br />has been discussed, considered and formally acted upon. The City Council further ratifies, approves and <br />confirms such written notice and the contents and posting thereof. <br />Section 29.
