Wilmore, Code Officer <br />SUBJECT: Cars on R.O.W. of Old La Porte Road, <br />DATE: May 24, 1984 <br />I originally received a telephone call from Mr. Ben Seymour and <br />he was upset because I had red tagged his vehicle which was parked <br />;along Old La Porte Road next to Louisiana Chemical. I informed Mr. <br />'Seymour that I had not tagged his car and that he should talk with the <br />police department whom he had called originally. I transferred him <br />back to the dispatcher at the police station, but she did not think he <br />needed to talk to them; therefore, she transferred him back to me. By <br />this time he was getting angry about the whole thing. I took his <br />phone number and then called and talked with Lt. Powell who in turn <br />had Sgt. Fields go and talk with the gentleman. Mr. Seymour insisted <br />that the land was private property so Sgt. Fields came to City Hall to <br />.verify this with the Engineering Department. They did not have any <br />;specific information to show that it was city right-of-way, so he <br />passed the information on to me and asked me to tag Mr. Seymour~s car <br />~as well as the other vehicle parked by his. <br />Sgt. Fields informed Mr. Seymour that I would be red tagging the <br />vehicles since it was private property and told~him if he had any <br />questions to contact me. Mr. Seymour did call and ask what my <br />procedure was and then asked me to definitely tag his car and go ahead <br />and schedule a hearing for him so he could tell the City what he <br />thought of our stupid laws. After talking with Mr. Seymour I talked <br />with Jesse Taylor who assured me that the property in question was <br />right-of-way property and that I did not have the authority. At that <br />time I contacted Betty Waters who found a December, 1982 memorandum <br />stating that the property was indeed a City right-of-way. I furnished <br />a copy of this memo to Sgt. Fields who was off duty at the time but <br />when he came back on duty several days later he had one of his men <br />arrange for the removal of both vehicles. <br />Enclosure <br />I <br />
