REQUEST FOR CITY COUNCIL AGENDA ITEM
Agenda Date Requested: September 22, 2008
Requested By: Tim Tietiens
Department: Planning
Report: X Resolution: Ordinance: X
Exhibits: Ordinance w/exhibits A -F
P&Z Staff Report
Aerial Map
Public Notice Responses
Appropriation
Source of Funds:
N/A
Account Number:
N/A
Amount Budgeted:
N/A
Amount Requested:
N/A
Budgeted Item: Yes
No
SUMMARY & RECOMMENDATION
The Planning and Zoning Commission, during its August 21, 2008, meeting, held a public hearing to receive
citizen comments regarding Special Conditional Use Permit Request #SCU08-006. The request, submitted by
Brent Heckendom c/o Allen & Kerber Auto Supply (NAPA Auto Parts), seeks approval of Special Conditional
Use Permit (SCUP) for an off-site parking for primary business located at 518 West Main Street. Off-site parking
is classified as a conditional use per Section 106-441; Table A, Commercial Uses, Chapter 106 of the Code of
Ordinances.
Allen & Kerber Auto Supply has been in business in La Porte for over twenty years. The nature of business pertains
to supply automotive parts and services to the general public and other businesses in the area. Over the past years, the
number of employees increased with the tremendous growth of business. Parking has remained a concern for this
facility. There are numerous times when private vehicles are parked along the shoulders of N. 5th Street within the
public right-of-way. The owner has purchased this property to provide parking for its employees. Off-site parking
will serve as auxiliary parking and will help alleviate parking problems associated with the business. In addition,
there is no other reasonable site available nearby.
The proposed location for off-site parking is within 300 feet of the principal building. The parking lot will be
constructed in accordance with City's standard specifications. Landscaping and screening shall be required as per
Section 106-444(a) of the Code of Ordinances of the City.
Recently, the owner has constructed an additional building at 516 West Main Street. Architectural Design
Standards for the Main Street were not in place at the time of plan approval. Staff discussed this matter with the
owner and he agreed to apply masonry products to the front of the newly constructed building. Staff included this
as a condition of the requested Special Conditional Use Permit. After receiving citizen input and discussion on the
upcoming Main Street Architectural Design Standards, the Commission deleted a condition #5 from the SCUP.
Nine (9) notices of public hearing were mailed to neighboring property owners. Two responses were received in
favor of the SCUP. The Planning and Zoning Commission, by a 5-2 vote, recommends City Council approval of
Special Conditional Use Permit #SCU08-006 with the conditions listed (omitting #5) in the SCUP.
C nduct public hearing.
C41sider Planning and Zoning Commission recommendation to approve Special Conditional Use Permit
#S U08-006 for off-site parking for business located at 518 West Main Street.
Council
Ron Bottoms, City Manager
