ORDINANCE NO. 001 51 <br />AN ORDINANCE AMENDING CHAPTER 106 "ZONING" OF THE CODE OF <br />ORDINANCES OF THE CITY OF LA PORTE IN ITS ENTIRETY IN CONNECTION <br />WITH COMPREHENSIVE REVIEW AND UPDATE; PROVIDING THAT ANY <br />PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED <br />GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A <br />SUM NOT TO EXCEED TWO THOUSAND DOLLARS; PROVIDING FOR THE <br />PUBLICATION OF THE CAPTION HEREOF; AND PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br />Section 1: That Chapter 106, "Zoning," of the Code of Ordinances of the City of LaPorte, Texas, is <br />hereby amended in its entirety and shall hereinafter read as follows: <br />"ARTICLE 1. IN GENERAL <br />Sec. 106-1. Definitions. <br />The following words, terms and phrases, when used in this chapter shall have the meanings <br />ascribed to them in this section, except where the context indicates a different meaning: <br />Abutting means having property or district lines in common, or two objects in immediate contact. <br />Access means of approaching or entering a property, includes a right of passage to and from an <br />adjacent street. <br />Accessory structure (applicable to non-residential uses) means a detached, subordinate structure, <br />the use of which is clearly incidental and related to that of the principal structure or use of the land, and <br />which is located in the same lots as that of the principal structure or use. <br />Accessory structure, use or building without required principal structure (applicable to large lot district <br />residential uses). Toolhouses, barns, sheds, storage buildings and livestock, without a principal structure, <br />shall be permissible use when located on tracts one acre in size or larger and situated within the large lot <br />district. Structure/use shall be for the property owner's personal use only (commercial use is not allowed). <br />Accessory use or building (applicable to residential uses). An "accessory use or building" is one <br />customarily a part thereof, which is clearly incidental and secondary to permitted use and which does not <br />change the character thereof, including but not limited to garages, carports, bathhouses, greenhouses, <br />tool sheds, or swimming pools. <br />Alley means a public way which, when at least 16 feet in width, may be used for vehicular service <br />access to the back or side of properties otherwise abutting on a street or highway. <br />Apartment. See dwelling, multifamily. <br />Artisan Shop means a micro -manufacturing facility designed for creation and retailing products. <br />Artisan means a skilled worker who makes items that may be functional or strictly decorative, <br />including but not limited to furniture, sculpture, clothing, jewelry, household items, tools, and handmade <br />machines such as a watch. <br />
