(d) Failure to begin construction within one year after issuance or as scheduled under the terms of a <br />special conditional use permit shall void the permit as approved, except upon an extension of time <br />granted after application to the planning and zoning commission. <br />(e) If construction is terminated after the completion of any stage and there is ample evidence that <br />further development is not contemplated, the division establishing such special conditional use <br />permit may be rescinded by the city council, upon its own motion or upon the recommendation of the <br />planning and zoning commission of the city, and the previous zoning of the entire tract shall be in full <br />effect on the portion which is undeveloped. <br />(f) Every special conditional use permit granted as provided herein shall be considered as an <br />amendment to the zoning ordinance as applicable to such property. <br />MMW����- � i <br />A special conditional use permit shall be issued only if all of the following conditions have been <br />found: <br />(1) That the specific use will be compatible with and not injurious to the use and enjoyment of other <br />property, nor significantly diminish or impair property values within the immediate vicinity. <br />(2) That the conditions placed on such use as specified in each district have been met by the <br />applicant. <br />(3) That the applicant has agreed to meet any additional conditions imposed, based on specific site <br />constraints, and necessary to protect the public interest and welfare of the community. <br />The procedure for amendments for a special conditional use permit shall be the same as for a new <br />application. <br />Any person desiring to improve property shall submit to the city planning department a certified site <br />plan of said premises and information giving the location and dimensions of existing and proposed <br />buildings and parking lots, location of easements crossing the property, any and all encroachments, and <br />other information which may be necessary to ensure conformance to this chapter. Approved site plan is <br />valid for 1 -year from the date of approval by the City. A certified site plan shall not be required when: <br />(1) Residential construction is only for an accessory building of less than 200 square feet; <br />(2) Residential construction is on lots or tracts that have been surveyed by a registered surveyor, <br />and have all property corners permanently marked and visible; or <br />(3) Residential construction consists of the modification of an existing residential structure. <br />(4) Small awning and routine maintenance, i.e. parking lot, pavement, & building addition of less <br />than 200 s.f. If approved by Director of Planning and Development after review of a previous <br />certified site plan and they find no indication that the improvement would violate the provisions <br />of this chapter. <br />
