RECONVENE PUBLIC HEARING TO CONSIDER ENTEX RATE APPLICATION - Mayor Meza stated that the meeting had been called to reconvene the public hearing to consider the Entex Rate Application, and asked if there was anyone present wishing to speak on the Entex Rate Application. There was no one wishing to speak. Mayor Meza further stated that the Commission felt that they were not qualified to determine the rate and hired the firms of Leonard, Koehn, Rose & Webb, rate attorneys, and Touche, Ross & Company, rate analysts. The City made an offer of 20~ increase and Entex did not wish to accept the offer. With no one present wishing to speak, the hearing was closed. + + + • 3. CONSIDER ENTEX RATE ORDINANCE NO. 1091 - After the proposed ordinance was read in full, motion by Commissioner Simons, seconded by Commissioner Kibodeaux to approve Ordinance No. 1091 as read. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, and Simons. NAYS: None. ABSENT: Commissioner Cline. CAPTION: AN ORDINANCE MAKING CERTAIN FINDINGS OF FACT; PRESCRIBING RATES TO BE CHARGED FOR DISTRIBUTION AND SALE OF NATURAL GAS WITHIN THE CITY, AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. -0- MR. HOWARD BELL - addressed the Commission, stating that he felt the City had lowered their rates as outlined in the ordinance. The City Attorney was of the opinion that there was no difference in the rates, and it was not the City's intention to decrease the rates that were in effect at the time of Entex's filing for an increase on December 27, 1976. • Mr. Bell further stated that he took exception to the "reasonable return" expressed in the ordinance. Entex would continue to work with the City in every way possible and appreciated the efforts of the Commission and Attorney, but, would appeal to the Railroad Commission. Mayor Meza expressed appreciation to the cooperation of Entex and their representatives.
