RECONVENE PUBLIC HEARING TO CONSIDER ENTEX RATE APPLICATION - <br />Mayor Meza stated that the meeting had been called to reconvene <br />the public hearing to consider the Entex Rate Application, and <br />asked if there was anyone present wishing to speak on the Entex <br />Rate Application. There was no one wishing to speak. <br />Mayor Meza further stated that the Commission felt that they <br />were not qualified to determine the rate and hired the firms <br />of Leonard, Koehn, Rose & Webb, rate attorneys, and Touche, <br />Ross & Company, rate analysts. The City made an offer of 20~ <br />increase and Entex did not wish to accept the offer. <br />With no one present wishing to speak, the hearing was closed. <br />+ + + <br />• <br />3. CONSIDER ENTEX RATE ORDINANCE NO. 1091 - After the proposed <br />ordinance was read in full, motion by Commissioner Simons, <br />seconded by Commissioner Kibodeaux to approve Ordinance No. 1091 <br />as read. Motion carried by the following vote: <br />AYES: Commissioners Tomerlin, Kibodeaux, and Simons. <br />NAYS: None. <br />ABSENT: Commissioner Cline. <br />CAPTION: AN ORDINANCE MAKING CERTAIN FINDINGS OF FACT; <br />PRESCRIBING RATES TO BE CHARGED FOR DISTRIBUTION AND SALE <br />OF NATURAL GAS WITHIN THE CITY, AND REPEALING ALL OTHER <br />ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. <br />-0- <br />MR. HOWARD BELL - addressed the Commission, stating that he <br />felt the City had lowered their rates as outlined in the <br />ordinance. The City Attorney was of the opinion that there <br />was no difference in the rates, and it was not the City's <br />intention to decrease the rates that were in effect at the <br />time of Entex's filing for an increase on December 27, 1976. <br />• <br />Mr. Bell further stated that he took exception to the "reasonable <br />return" expressed in the ordinance. Entex would continue to <br />work with the City in every way possible and appreciated the <br />efforts of the Commission and Attorney, but, would appeal to the <br />Railroad Commission. <br />Mayor Meza expressed appreciation to the cooperation of Entex <br />and their representatives. <br />
