Second by Councilperson <br />Thrower. The motion carried, 8 ayes and 0 nays. <br />Ayes: Councilpersons Cooper, Thrower, McLaughlin, Porter, <br />Gay, Maxwell, Clarke and Mayor Malone <br />Nays: None <br />7. Consent Agenda - Council considered awarding contract and bids <br />as follows: (A) Consider awarding annual contract to Excell <br />Materials Inc., for concrete; (B) Consider awarding annual <br />contract to Stabilized Products for cement stabilized sand; <br />(C) Consider rejecting bids for items 1 and 3, and award <br />annual contract for items 2, 4 and 5 to Cues, Inc., for <br />manhole chemical sealing materials; (D) Consider awarding bid <br />to Dow Fence and Supply for fencing at Bay Forest Golf Course. <br />Councilperson McLaughlin requested item A be removed from the <br />consent agenda for further discussion. Councilperson Clarke <br />requested item C be removed for further discussion. <br />Director of Public Works Steve Gillett led discussion <br />regarding bid tabulations for cement stabilized sand. After <br />discussion Councilperson McLaughlin recommended that the <br />contract be awarded to the local contractor DorBett Brothers. <br />City Manager Robert T. Herrera stated, "Let me qualify a <br />couple of the statements that were the staff's point of view. <br />We clearly understand that it has been this council's <br />direction to try to do business locally. Each time we <br />tabulate bid responses, where there is a local vendor involved <br />we attempt to try to do business with them. One of our <br />responsibilities, from the staff point of view, is to insure <br />that we are not criticized by the open public for doing <br />business in such a fashion as someone can come back and have <br />a legal remedy against the City. That is why staff has been <br />careful over the years to recommend what we believed to be the <br />low responsive bidder. That does not necessarily mean that <br />the City Council has to take the recommendation of the City <br />staff. Our job is to recommend what we believe is the low <br />bidder. The Council can accept it or reject it. If you were <br />to reject it, we would ask that you reject it and name a party <br />to receive the bid." <br />
