Second by <br />Councilperson Westergren. The motion carried, 9 ayes and 0 <br />nays. <br />Ayes: Councilpersons Waters, Pfeiffer, Gay, Skelton, <br />Westergren, Malone, Bridges, Matuszak and Mayor Cline <br />Nays: None <br />5. Mayor Cline declared the public hearings open. <br />A. The first public hearing was to hear the request of Don <br />Welch to rezone Reserve Tract K in Brookglen, Section III, <br />from R-1 to Commercial to allow retail-commercial development. <br />Mr. John Welch reviewed the request for Council and stated <br />• that all they are asking for at this time is a rezoning of the <br />eastern .67 acres of the tract. The property is located at <br />the northwest corner of Brookwood and Fairmont Parkway. A <br />convenience store is planned to be built on this site. <br />Councilperson Westergren asked if the ordinance reflected the <br />legal description as Mr. Welch is now requesting. City <br />Attorney Askins replied that it was shown on page C-5 of the <br />public hearing backup material and would be included as <br />"Exhibit F" in the ordinance. <br />Councilperson Matuszak inquired about planned landscaping at <br />the convenience store. Mr. Welch said he did not recall what <br />the site plan called for. <br />Mayor Cline asked if there was anyone who wished to speak in <br />favor of this request. No one came forward. <br />Mayor Cline asked if there was anyone who caished to speak in <br />opposition to this rezoning. There was no response. <br />The hfayor declared the public hearing closed and asked the <br />City Secretary to read the recommendation of Planning & <br />Zoning. The City Secretary did so; their recommendation was <br />to approve the rezoning of the unrestricted reserve K east of <br />the pipeline from temporary R-1 to commercial, and that the <br />• rezoning of the the western portion be denied. <br /> <br />I <br />
