Council considered an ordinance adopting provisions of Chapter <br />92, Texas Property Code, .relating to smoke detectors in <br />residential dwelling units which are rented or leased. <br />The City Attorney read: ORDINANCE 1093-C - AN ORDINANCE <br />ADOPTING THE PROVISIONS OF CHAPTER 92, TEXAS PROPERTY CODE, <br />RELATING TO SMOKE DETECTORS IN RESIDENTIAL DWELLING UNITS <br />WHICH ARE RENTED OR LEASED; PROVIDING A REPEALING CLAUSE; <br />PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT ANY PERSON <br />VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE FINED IN ANY <br />SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); PROVIDING <br />CIVIL REMEDIES; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; <br />AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Fire Marshal Paul Hickenbottom reviewed the reasons for the <br />changes to the ordinance. The proposed ordinance will track <br />State law more efficiently. Discussion by Council followed. <br />Motion was made by Councilperson McLaughlin to table this item <br />for a workshop. Second by Councilperson Skelton. The motion <br />carried, 5 ayes and 4 nays. <br />Ayes: Councilpersons Sutherland, Matuszak, McLaughlin, <br />Gay, and Skelton <br />Nays: Councilpersons Cooper, Porter, Clarke and Mayor <br />Malone <br />The City Manager asked for direction from Council. Consensus <br />was that more information is needed on what can and cannot be <br />done and that legal counsel be consulted regarding this. <br />7. Council considered an ordinance authorizing an agreement with <br />Harris County for food establishment sanitation regulation <br />enforcement . <br />The City Attorney read: ORDINANCE 1743 - AN ORDINANCE OF THE <br />CITY OF LA PORTE, PROVIDING FOR THE SALE OF ONLY SOUND, <br />PROPERLY LABELED FOOD; ESTABLISHING SANITATION STANDARDS FOR <br />FOOD PROTECTION AND SERVICE; ADOPTING BY REFERENCE TEXAS <br />DEPARTMENT OF HEALTH "RULES ON FOOD SERVICE SANITATION" AND <br />"RULES ON RETAIL STORE SANITATION," AND THE "RULES ON FOOD <br />SERVICE SANITATION FOR HARRIS COUNTY, TEXAS"; REQUIRING <br />PERMITS FOR THE OPERATION OF FOOD ESTABLISHMENTS; DESIGNATING <br />THE DIRECTOR OF THE HARRIS COUNTY HEALTH DEPARTMENT AS THE <br />HEALTH AUTHORITY; REQUIRING FOOD SERVICE MANAGER CERTIFICATION <br />IN FOOD SANITATION; AND PROVIDING REMEDIES AND PENALTIES FOR <br />VIOLATIONS OF THE ORDINANCE. <br />
