<br />. <br /> <br />. <br /> <br />ORDINANCE NO. 844 <br /> <br />. <br /> <br />AN ORDINANCE ADOPTING AND MAKING APPLICABLE TO THE CITY <br />OF LA PORTE THE PROVISIONS OF STATE LAW RELATING TO WORKMEN'S <br />COMPENSATION INSURANCE FOR MUNICIPAL EMPLOYEES; PROVIDING <br />THAT THE CITY OF LA PORTE SHALL BE SELF-INSURING; PROVIDING <br />THAT SAID WORKMEN'S COMPENSATION INSURANCE SHALL BE APPLICABLE <br />TO ALL EMPLOYEES OF THE CITY OF LA PORTE; PROVIDING FOR <br />NOTICES OF SUCH ACTION TO BE GIVEN; ESTABLISHING THE CITY OF <br />LA PORTE WORKMEN'S COMPENSATION ACCOUNT; AND PROVIDING FOR <br />~HE EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Commission of the City of La Porte <br />hereby adopts the provisions of Article 830ge-2, Vernon's <br /> <br />. <br /> <br />Revised Civil Statutes of Texas (Acts 1969, 6lst Legislature, <br />Page 87, Chapter 22), and makes the same applicable to all of <br />the employees of the City of La Porte. <br />Section 2. The City of La Porte hereby elects to <br /> <br />become a self-insurer under the provisions of said Article <br /> <br />830ge-2, Vernon's Revised Civil Statutes of Texas. <br /> <br />Section 3. The City Clerk is hereby directed to give <br /> <br />notice to the Texas Industrial Accident Board, stating the <br /> <br />effective date of the self-insurance, which shall be the <br /> <br />effective date of this Ordinance; advising the Industrial <br />Accident Board that all employees of the City of La Porte <br /> <br />shall be covered by such workmen's compensation benefits; <br /> <br /> and advisi~g the approximate number of employees to be <br />~ <br />covered, and the estimated amount of the payroll or payrolls. <br /> Notice shall also be, given by the City Clerk to the employees <br /> of the City, that provision has been made by the adoption <br /> <br />of this ordinance, for workmen's compensation benefits and <br /> <br />the effective date thereof, which shall be the effective date <br /> <br />of this ordinance; and all employees of the City of La Porte <br /> <br />shall be conclusively deemed to have accepted the compensation <br /> <br />. <br /> <br />provisions in lieu of common-law or statutory liability or <br />cause of action, if any, for injuries received in the course <br />of employment or death resulting from injuries so received. <br />Section 4.
