<br />~, <br /> <br />e'-'~ <br /> <br />e-, <br /> <br />a~, <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />874 <br /> <br />AN ORDINANCE PROHIBITING THE INHALATION OF THE CONTENTS OF <br />PRODUCTS PACKAGED IN GAS PRESSURIZED SPRAY CONTAINERS; CON- <br />TAINING DEFINITIONS; PROVIDING THAT ANY PERSON VIOLATING <br />THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND <br />UPON CONVICTION SHALL BE FINED IN AN AMOUNT NOT TO EXCEED <br />TWO HUNDRED DOLLARS ($200.00), AND THAT EACH DAY OF ANY <br />SUCH VIOLATION SHALL BE DEEMED A SEPARATE OFFENSEJ AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Pressur~zed spray containers--Definition. <br /> <br />As used in this Ordinance, "pressurized spray container" <br /> <br />shall mean any product, the contents of which are packaged <br /> <br />under gas pressUre in a can, so that the user may discharge <br /> <br />the product contents in a spray or mist form. <br /> <br />Section 2. Same--Inhalation of fumes prohibited. <br /> <br />No person shall, for the purpose of causing a condition <br /> <br />of intoxication, euphoria, excitement, exhilaration, stupe- <br /> <br />faction, or dulling of the senses or nervous system, <br /> <br />intentionally smell or inhale the spray, mist, or gas <br /> <br />discharge from any pressured spray container; provided, <br /> <br />however, that this section shall not apply to the inhalation <br /> <br />of any medicine for medical or dental purposes, if such <br /> <br />inhalation is caused by or administered by any licensed <br /> <br />doctor, physician, dentist, anesthesiologist, or other <br /> <br />licensed person engaging in the medical or dental profession. <br /> <br />Section 3. Penalty for violation of Ordinance. <br />Any person who shall violate any provision of this <br /> <br />Ordinance shall be deemed guilty of a misdemeanor, and upon <br /> <br />conviction shall be fined in an amount not to exceed Two <br /> <br />Hundred Dollars ($200.00). Each d~of any such violation <br /> <br />shall be deemed a separate offense. <br /> <br />Section 4. Effective date. <br /> <br />This Ordinance shall be effective upon its passage, <br /> <br />approval, and publication, as required :bylaw. <br />
