<br />&.' <br /> <br />.. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />e <br /> <br />ORDINANCE NO. <br /> <br />940 <br /> <br />AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF <br />THE CITY OF LA PORTE; REGULATING THE PRACTICE OF GOING IN AND <br />UPON PRIVATE RESIDENCES IN THE CITY OF LA PORTE, TEXAS, BY <br />VENDORS, WITHOUT THE INVITATION OF THE OWNER OR OCCUPANT; <br />DECLARING THE SAME TO BE A NUISANCE; PROVIDING THAT ANY <br />PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED <br />GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED <br />IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); <br />CONTAINING A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE <br />HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. The Code of Ordinances of the City of La Porte <br /> <br />is hereby arnended by repealing Chapter 17, Section 17-1 through <br /> <br />17-21, both inclusive, thereof, and substituting therefor the <br />fOllowing, to-wit: <br /> <br />"Section 17-1. Uninvited peddling at private residences <br />declared a nuisance. <br /> <br />"The practice of going in and upon private residences, <br />including rnulti-farnily dwellings, in the City of La Porte, <br />Texas, by solicitors, peddlers, hawkers, itinerant rnerchants, <br />or transient vendors of any goods, wares, merchandise, serv- <br />ices, photographs, rnagazines or subscriptions to rnagazines, <br />not having been requested or invited so to do by the owner or <br />owners, occupant or occupants of said private residences for <br />the purpose of SOliciting orders for the sale of any goods, <br />wares, rnerchandise, services, photographs, rnagazines or sub- <br />scriptions to rnagazines, and disposing of, peddling or hawking <br />the sarne, is hereby declared to be a nuisance and punishable <br />as such nuisance as a rnisderneanor. <br /> <br />"Section 17-2. Sarne--Nuisance ordered abated. <br /> <br />"The Chief of Police and police officers of the City of <br />La Porte, Texas, are hereby required and directed to suppress <br />the sarne and to abate any such nuisance as is described in <br />Section 17-1 hereof." <br /> <br />Section 2. Any person who shall violate any provision <br /> <br />of this ordinance shall be deerned guilty of a rnisderneanor and <br />upon conviction shall be punished by a fine not to exceed Two <br /> <br />Hundred Dollars ($200.00). <br /> <br />Section 3. This Ordinance shall be effective fourteen <br /> <br />(14) days after its passage and approval. The City Clerk shall <br /> <br />give notice of the passage of this ordinance by causing the <br />caption hereof to be published in the official newspaper in <br /> <br />the City of La Porte at least twice within ten (10) days <br /> <br />after the passage of this ordinance. <br />
