<br />. , <br /> <br />ORDINANCE NO. 974 <br /> <br />-. <br /> <br />AN ORDINANCE A.MENDING SECTION 21-28 OF ARTICLE III, "VACATING, <br />ABANDONING AND CLOSING STREETS AND ALLEYS," OF THE CODE OF <br />ORDINANCES OF THE CITY OF LA PORTE; AND PROVIDING AN EFFECTIVE <br />DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 21-28 of Article III, "Vacating, <br /> <br />abandoning and closing streets and alleys," of the Code of <br /> <br />Ordinances of the City of La Porte, is hereby amended, and <br /> <br />shall hereafter read as follows, to-wit: <br /> <br />"Sec. 21-28. Final determination by Commission; appraisal; <br />conveyance. <br /> <br />-. <br /> <br />"Upon compliance witb all provisions of this article, <br />the city commission shall make a final determination as to <br />whether or not an application filed under this article shall <br />be granted or denied. Streets or alleys, whether owned by <br />the city in fee or used by easement, may be sold to the <br />abutting owner or owners in proportion to their abutting <br />ownership, such division between owners to be made in an <br />equitable manner. In addition, any land or interest <br />therein which was originally acquired for the purpose of <br />streets, rights-of-way or easements which the city chooses <br />to trade or exchange as consideration for other land <br />acquired for streets, rights-of-way or easements, includ- <br />ing transactions which may be partly for cash and partly <br />by trade or exchange. Nothing in this article shall <br />require the city commission to accept any bid or offer <br />or be required to consummate any sale or trade. Any <br />conveyance, sale or trade made under this article shall <br />never be for less than the fair market value of the land <br />or interest being conveyed, sold, or traded, as determined <br />by an appraisal obtained by the city commission at appli- <br />cant's expense, which shall be conclusive of the market <br />value thereof; all as provided in Art. 5421c-12, Revised <br />Civil Statutes." <br /> <br />-. <br /> <br />Section 2.
