<br />Ordinance No. 1000-1-Je <br />Page 3 <br /> <br />e <br /> <br />WHEREAS, the City has, pursuant to the terms of said Code, made its <br /> <br />investigation to ascertain whether, if said variance is granted, said new applicant would <br /> <br />qualify for a beer and/or wine permit from the City; and <br /> <br />WHEREAS, the City has determined that the issuance of a variance to Chapter 6 <br /> <br />of the Code of Ordinances of the City of La Porte is desirable and should be approved <br /> <br />by the City Council; and <br />WHEREAS, the City has determined that the new applicant therefore qualifies for <br /> <br />a beer and/or wine permit from the City. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LA PORTE: <br /> <br />Section 1. Pursuant to Chapter 109.33 of The Texas Alcoholic Beverage <br /> <br />Code, Applicant is granted a variance to Chapter 6, Section 6.2 of the Code of <br /> <br />Ordinances of the City of La Porte, permitting the serving of beer and/or wine at a <br /> <br />restaurant location situated within 300 feet of a public school within the La Porte <br /> <br />Independent School District. Said variance is granted to Applicant named below in <br /> <br />Section 3 of this ordinance at the specific location stated therein. <br /> <br />Section 2 <br /> <br />Applicant is granted a variance to Chapter 6, Section 6.3 of the <br /> <br />Code of Ordinances of the City of La Porte, permitting the serving of beer and/or wine <br /> <br />at a restaurant location situated on City-owned property. Said variance is granted to <br /> <br />Applicant named below in Section 3 of this ordinance at the specific location stated <br /> <br />therein. <br />
