<br />~ <br /> <br />. <br /> <br />- <br /> <br />a <br /> <br />- <br /> <br />.-' <br /> <br />. <br /> <br />. <br /> <br />, , <br /> <br />THE STATE OF TEXAS S <br /> <br />eOUNTY OF HARRIS <br /> <br />EXTRATERRITORIAL JURISDICTION <br />SETTLEMENT AGREEMENT <br />i <br /> <br />s <br /> <br />THAT, WHEREAS, by virtue of the Municipal Annexation Act, <br /> <br />House Bill No. 13, Acts of the 58th Legislature, Regular Session, <br /> <br />ehapter 160 [compiled by Vernon Law Book eompany, and published <br /> <br />by it, as Art. 970a, V.A.C.S.], the Legislature' of the State of <br /> <br />Texas provided for the several incorporated cities of the State of <br /> <br />Texas to exercise specifie~ extraterritorial jurisdiction over <br />territory without, but contiguous to, their respective corporate <br /> <br />limits, the geographical extent.of which is governed by the popu- <br /> <br />lation of the particular incorporated city; and <br /> <br />WHEREAS, by virtue of its population, the eity of Shoreacres, <br /> <br />Texas, has an extraterritorial jurisdiction of all the contiguous, <br /> <br />unincorporated area, not a part of any other city, within one-half <br /> <br />(1/2) mile of the corporate limits of the eity of Shoreacres, Texas; <br /> <br />and, <br /> <br />WHEREAS, by virtue of its population, the eity of La Porte, <br /> <br />Texas, has an extraterritorial jurisdiction of all the contiguous <br /> <br />unincorporated area, not a part of any other city, within one (1) <br /> <br />mile of the corporate limits of the City of La Porte; and <br /> <br />WHEREAS, by virtue of the location of the corporate limits <br /> <br />of the cities of Shoreacres, Texas, and La Porte, Texas, the <br /> <br />extraterritorial jurisdiction of the two cities overlap; and, <br /> <br />WHEREAS, by Section 3B, of the said Municipal Annexation <br /> <br />Act, incorporated cities whose territories so overlap are authorized <br /> <br />to apportion such overlapped area by mutual agreement of the govern- <br /> <br />ing bodies of the cities concerned, such agreement to be in writing <br /> <br />and to be approved by an ordinance or resolution adopted by the <br /> <br />governing bodies of the cities concerned; and, <br /> <br />WHEREAS, it is the desire of the cities of Shoreacres, Texas, <br /> <br />and La Porte, Texas, to so apportion the aforementioned overlapped <br /> <br />extraterritorial jurisdiction; and, <br />
