<br />~ . <br />. ,.r . . <br />,\, <br />.~ . <br /> <br />. <br /> <br />ORDINANCE NO. 1057 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO, 1052 AND AUTHORIZING AND <br />DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY OF LAPORTE <br />e FOR AND ON BEHALF OF THE CITY OF LAPORTE TO EXECUTE AND TO AFFIX <br />THE SEAL OF THE CITY TO A MODIFICA TION OF THE EXISTING AGREEMENT OF <br />LEASE BETWEEN THE CITY, AS LESSOR AND GREGORY AVIATION, AS LESSEE, <br />PROVIDING THEREIN THAT THE TERM OF THE LEASE SHALL BEGIN ON THE <br />23RD DAY OF NOVEMBER 1976 AND END ON THE 31ST DAY OF DECEMBER 1996; <br />ACCORDING TO THE TERMS, PROVISIONS, AND CONDITIONS CONTAINED IN <br />SAID MODIFICATION AGREEMENT, A COpy OF WHICH IS ATTACHED HERETO <br />AND MADE A PART HEREOF; PROVIDING A SAVINGS CLAUSE; AND PROVIDING <br />AN EFFECTIVE DA TE OF THIS ORDINANCE. <br /> <br />WHEREAS, the CITY OF LaPORTE, as Lessor, and GREGORY AVIATION, <br /> <br />as Lessee, have entered into an Airport Lease Agreement dated November 1, 1976; <br /> <br />and <br /> <br />WHEREAS, GREGORY AVIATION, desires that said Airport Lease Agreement <br /> <br />be modified to provide that the term of the Lease begins on the 23rd day of November <br /> <br />e1976 and ends on the 31st day of December 1996; and <br /> <br />WHEREAS, the CITY OF LAPORTE has agreed with the said GREGORY <br /> <br />A VIA TION, upon the terms, conditions, and agreements of a modification of <br /> <br />said Lease; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> <br />CITY OF LAPORTE: <br /> <br />Section 1. That the Mayor and the City Clerk of the CITY OF LAPOR TE, Texas, <br /> <br />be, and they are hereby authorized and directed to execute for and on behalf of said <br /> <br />City a modification of the existing agreement of Lease with GREGORY A VIA TION, <br /> <br />ea co-partnership, providing therein that the term of the Lease shall begin on <br /> <br />November 23, 1976 and end on December 31, 1996, according to the terms, provisions, <br /> <br />and conditions contained in such agreement, a copy of which is attached hereto, <br /> <br />incorporated by reference herein and made a part hereof for all purposes. <br /> <br />Section 2: If any section, paragraph, clause, or sentence shall be declared <br /> <br />void and unenforceable or unconstitutional, it is hereby declared to be the intention <br /> <br />of the Commission that the remainder of such Ordinance shall remain in full force <br /> <br />and effe ct, <br /> <br />-1- <br /> <br />e <br />
