<br />e <br /> <br />. <br /> <br />. <br /> <br />~ <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE NO. /.2:23 <br /> <br />AN ORDINANCE DECLARING AN EMERCENCY DUE TO HURRICANE ALLEN, <br />AND POSTPONING THE SPECIAL CHARTER ELECTION FROM AUGUST 9, <br />1980 UNTIL AUGUST ~ 1980; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. The Governor of Texas has issued a proclamation, <br /> <br />delegating authority to the Texas Secretary of State, to enact <br /> <br />rules and regulations concerning the postponement of election <br /> <br />in Texas coastal counties, including Harris County. The Texas <br /> <br />Secretary of State has promulgated Rule 004.30.01.221, granting <br /> <br />permissive authority to local governmental units, to postpone <br /> <br />elections called for August 9, 1980, for not more than fourteen <br /> <br />(14) days. <br /> <br />Section 2. Pursuant to the authority granted by the Secre- <br />tary of State, the City Commission of the City of La Porte de- <br /> <br />c1ares an emergency, and hereby orders that the special charter <br /> <br />election, heretofore ordered for the 9th day of August, 1980, <br /> <br />shall be postponed, and is hereby ordered to be held on the <br /> <br />~a~ day of August, 1980. <br />Section 3. Absentee voting shall resume on the ~ day <br />of August, 1980, and shall continue through the J't!. day of <br />August, 1980, which is the 4th day preceeding the election. <br /> <br />Section 4. Except as amended by this Ordinance, Ordinance <br /> <br />1216 shall remain in full force and effect. <br /> <br />Section 5. The City Commission of the City of La Porte <br /> <br />hereby finds, determines and declares that, due to the imminent <br /> <br />threat created by Hurricane Allen, a state of emergency exists <br /> <br />within the City of La Porte. <br /> <br />Section 6. The City Commission officially finds, determines, <br /> <br />reci tes and declares that a sufficient written notice of the <br /> <br />date, hour, place and subject of this meeting of the City <br /> <br />Commission was posted at a place convenient to the public <br />
