Within sixty (60) days after <br /> <br />obtaining all necessary permits, licenses, authorizations and <br />certificates, and after completion of make-ready work by utility <br />companies in connection with use of utility poles and facilities, <br />Grantee shall commence construction and installation of its CATV <br />System, subject to the conditions of this franchise. <br />C. Initial Rendering of Service. Within one year after <br />commencement of construction and installation of its CATV System, <br />Grantee shall accomplish significant construction of its CATV <br />System; provided, however, that the utility companies make their <br />~ poles and facilities available to Grantee in a reasonable manner <br />so as to meet this time schedule. As a minimum, but subject to <br />the provisions of Section 26 hereof, this requirement shall mean <br />Grantee shall be capable of providing Regular Subscriber Service <br />to sixty-five percent (65%) of the residents of the Franchise <br />Area. <br /> <br />D. Installation Requirement Thereafter. The year following <br />the first Anniversary Date of commencement of construction and in- <br />stallation. Grantee shall pursue to completion the construction <br />and installation of its CATV System with reasonable diligence. <br />~ E. Compliance. Failure of Grantee to commence and dili- <br />gently pursue each of the foregoing requirements and to abide by <br />and to complete each of the matters set forth herein shall be <br />grounds for termination of this franchise; provided, however, <br />Grantee shall notify City Commission as soon as reasonably possible <br />of any major delay in meeting the construction schedule estab- <br />lished under this franchise. Grantee shall not be held in default <br />of this construction schedule if timely completion of any phase of <br />construction is prevented despite Grantee's good faith efforts <br />and because of circumstances beyond Grantee's control. <br /> <br />. <br />
