<br />. . <br /> <br />ORDINANCE NO. 1139 <br /> <br />. <br /> <br />AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE <br />INTERSECTION OF NORTH HOLMES AVENUE AND EAST "D" STREET; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />WHEREAS, the City Commission of the City of La Porte has <br />been requested by the record owners of all of the property <br /> <br />abutting the hereinafter described portion of the intersection <br /> <br />of North Holmes Avenue and East "D" Street, to vacate, abandon, <br /> <br />and permanently close said portion of the intersection of <br /> <br />North Holmes Avenue and East liD" Street; and <br /> <br />. <br /> <br />WHEREAS, the City Commission of the City of La Porte has <br />determined, and does hereby find, determine and declare that <br /> <br />the hereinafter described portion of the intersection of North <br /> <br />Holmes Avenue and East "0" Street is not suitable, needed, or <br /> <br />beneficial to the public as a public road or street, and that <br /> <br />the closing of the hereinafter described portion of the inter- <br /> <br />section of North Holmes Avenue and East "D" Street is for the <br /> <br />protection of the public and for the public interest and <br />benefit, and that the hereinafter described portion of said <br /> <br />intersection of North Holmes Avenue and East "D" Street should <br /> <br />be vacated, abandoned, and permanently closed; <br /> <br />e <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br />CITY OF LA PORTE: <br /> <br />Section l. Under and by virtue of the power granted to <br /> <br />the City of La Porte under its Home Rule Charter and Chap. l3, <br />Title 28, Art. II 75, of the Revised Civil Statues of the State <br />of Texas, 1925, the portion of the intersection of North Holmes <br />Avenue and East " D" Street, which portion is described in <br />Exhibit "A" and pictured in Exhibit "B", each of which Exhibits <br /> <br />are attached hereto and made a part hereof by reference, is <br /> <br />hereby permanently vacated, abandoned, and closed by the City <br /> <br />of La Porte. <br /> <br />ee <br />
