<br />. <br /> <br />. <br /> <br />Ordinance No. <br /> <br />1093 <br /> <br />, Page 2. <br /> <br />. <br /> <br />Section 2. Every dwelling unit within an existing <br />apartment, condominium, townhouse, and every guest room in a <br />hotel or motel, and every basement or cellar within such <br />dwellings in the City of La Porte, shall meet the require- <br />ment of Section 1127, as amended, within five (5) years, <br />with a minimum of twenty per cent (20%) of the total number <br />of dwelling units having smoke detectors installed each year. <br />The time period shall begin November 1, 1977. <br />Section 3. The owner or operator of each apartment <br />house, condominium, townhouse, hotel and motel situated within <br />the City of La Porte, shall annually, not later than November 1 <br />of each year, file an affidavit with the Fire Marshal of the <br />City of La Porte, certifying that each said smoke detector <br />has been tested and is in an operable condition. <br />Section 4. Smoke detectors must be installed in one- or <br />two-family dwellings when interior alterations, repairs, or <br />additions are made that require a building permit be obtained <br />from the building department. <br />Section 5. If any section, paragraph, subdivision, <br />clause, phrase or provision of this Ordinance shall be judged <br />invalid or unconstitutional, the same shall not effect the <br />validity of this Ordinance as a whole or any part or portion <br />thereof, other than the portion so decided to be invalid or <br />unconstitutional. <br />Section 6. In the addition to and cumulative of all <br />other penalties, the City shall have the right to seek <br />injunctive relief for any and all violations of this Ordinance. <br />Section 7. Any person, as defined in Secti9n 1.07(27), <br />Texas Penal Code, who shall violate any provision of this <br />Ordinance, shall be deemed guilty of a misdemeanor and upon <br />conviction shall be punished by a fine not to exceed Two <br />Hundred Dollars ($200.00). <br />Section 8.
