<br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />1095 <br /> <br />. <br /> <br />AN ORDINANCE AMENDING CHAPTER 10, SECTION 10-4, OF THE CODE <br />OF ORDINANCES OF THE CITY OF LA PORTE, "ARSON REWARD"; <br />DEFINING ARSON; PROVIDING THAT ANY PERSON VIOLATING THE TERMS <br />OF THIS ORDINANCE SHALL BE DEE~mD GUILTY OF A MISDEMEANOR AND <br />UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO <br />HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE DATE <br />HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 10-4, "Arson Reward," under Chapter <br /> <br />10, Fire Prevention and Protection, of the Code of Ordinances <br /> <br />of the City of La Porte, is hereby amended, and shall hereafter <br /> <br />read as follows, to-wit: <br /> <br />"Section 10-4. Arson Reward. <br /> <br />. <br /> <br />"(a) There is hereby offered to any person who shall <br />be responsible for, or who shall furnish information <br />leading to, the arrest and conviction of any person guilty <br />of arson committed within the city limits, a reward in <br />the sum of two hundred fifty dollars ($250.00). Such <br />reward shall be paid to such person, by the city treasurer <br />out of the general funds of the city upon proof to the <br />city commission that such person is in fact responsible <br />for, or has furnished information leading to, the arrest <br />and conviction of such criminal, and after a resolution <br />has been duly passed by the city commission finding such <br />facts and authorizing such payment. <br /> <br />"(b) The term 'arson' as used herein means the.wilful <br />burning of any habitation or building. <br /> <br />(1) 'Habitation' means a structure or vehicle that <br />is adapted for the overnight accommodation of persons <br />and includes: <br /> <br />(A) each separately secured or occupied portion <br />of the structure or vehicle; and <br /> <br />. <br /> <br />(B) each structure appurtenant to or connected <br />with the structure or vehicle. <br /> <br />(2) 'Building' means any structure or enclosure <br />intended for use or occupation as a habitation or <br />for some purpose of trade, manufacture, ornament, <br />or use. <br /> <br />liCe) The offense of arson authorizing the payment of <br />the reward under this section shall be deemed complete <br />when the fire has actually been communicated to a habit- <br />ation or building, though the habitation or building is <br />neither destroyed nor seriously injured. <br /> <br />"(d) No officer in the employe of the city, county <br />or state, whose duty it is to detect violations of the <br />law or make arrests in connection therewith, shall be <br />entitled to any reward for information leading to the <br />arrest and conviction of any person guilty of arson." <br /> <br />. <br />
