<br />e <br /> <br />. <br /> <br />-77- <br /> <br />use permit may be rescinded by the City Council, upon its own <br />motion or upon the recommendation of the Planning and Zoning <br />Commission of the City of La Porte, and the previous zoning of the <br />entire tract shall be in full effect on the portion which is <br />undeveloped. <br /> <br />5. Every special conditional use permit granted as provided herein <br />shall be considered as an amendment to the Zoning Ordinance as <br />applicable to such property. <br /> <br />10 - 202 Conditions for Aooroval. A Special Conditional Use Permit <br />shall be issued only if all of the followina conditions have <br />been found. <br /> <br />1. That the specific use will be compatible with and not injurious to <br />the use and enjoyment of other property, nor significantly diminish <br />or impair property values within the immediate vicinity. <br /> <br />2. That the conditions placed on such use as specified in each <br />district have been met by the applicant. <br /> <br />3. That the applicant has agreed to meet any additional conditions <br />imposed, based on specific site constraints, and necessary to <br />protect the public interest and welfare of the community. <br /> <br />10 - 203 Amendments <br /> <br />The procedure for amendments for a Special Conditional Use Permit shall <br />be the same as for a new application. <br /> <br />10 - 300 Accessorv Buildinas. Uses and Eauioment <br /> <br />1. No accessory buildings, uses or structures shall be erected or <br />located in any required yard other than the rear yard except: <br /> <br />A detached private garage as defined, may be permitted in side <br />yards, provided: (1) it complies with all the requirements of this <br />section: (2) it shall be five feet (5') or more from side lot <br />lines: and (3) the side yard does not abut a street right-of-way. <br /> <br />Accessory Buildings built on a skid foundation, no larger than one <br />hundred twenty (120) square feet and no more than one story in <br />height may be located in utility easements in required rear yards, <br />except that they may not be located closer than three feet (3') <br />from a side or rear property line or closer than six feet (6') from <br />any other structure. <br /> <br />EXHIBiT D <br />
