<br />. <br /> <br />. <br /> <br />e <br /> <br />ORDINANCE NO. 1407 <br /> <br />AN ORDINANCE RECITING THE CIRCUMSTANCES 'OF THE HOUSTON LIGHTING <br />& POWER COMPANY (HL&P) STATEMENT OF INTENT TO CHANGE ELECTRIC <br />RATES; SUSPENDING THE SCHEDULE OF RATES OF HL&P FOR A PERIOD <br />OF NINETY (90) DAYS FROM THE EFFECTIVE DATE THEREOF; AND PRO- <br />VIDING AN EFFECTIVE DATE FOR THIS ORDINANCE. <br /> <br />WHEREAS, on June 15, 1984, the Houston Lighting & Power <br />Company (HL&P) filed a Statement of Intent to change its rates <br /> <br />for electric service within the City of La Porte and has <br /> <br />requested that said changes become effective on July 20, 1984; <br /> <br />and <br /> <br />e <br /> <br />WHEREAS, HL&P has filed revised Tariff Schedules together <br /> <br />with statements specifying in detail each proposed change, a <br /> <br />rate filing package, and supporting testimony; and <br /> <br />WHEREAS, Section 17 (a) of the Public Utility Regulatory <br /> <br />Act, Article l446c, Texas Revised Civil Statutes, gives the <br /> <br />governing body of each municipality exclusive original juris- <br /> <br />diction over electric rates within its municipal boundaries; <br /> <br />and <br /> <br />WHEREAS, Section 43(d) of the Public Utility Regulatory <br /> <br />Act authorizes the governing body of any municipality acting <br />e as a Regulatory Authority to suspend the operation of any pro- <br />posed change in rates for a period not to exceed 90 days beyond <br /> <br />the date on which the scheduled rates WDuld otherwise go into <br /> <br />effect, which period may be further extended for an additional <br /> <br />150 days by the Texas Public Utility Commission; and <br /> <br />WHEREAS, HL&P I s proposed rate changes and the detailed <br /> <br />material supporting those changes require comprehensive evalu- <br /> <br />ation and study; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />e <br /> <br />Section 1.
