<br />. <br /> <br />. <br /> <br />. .. f'" <br /> <br />ORDINANCE NO. l387-A <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. l387 OF THE CODE OF ORDINANCES OF <br />THE CITY OF LA PORTE: CHANGING THE DEFINITION OF THE "JUNKED VEHICLE" <br />CONTAINED IN SAID ORDINANCE: PROVIDING THAT ANY PERSON VIOLATING THE <br />TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND <br />UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED <br />DOLLARS ($200.00); CONTAINING A SEVERABILITY CLAUSE: FINDING COMPLIANCE <br />WITH THE OPEN MEETING LAW: AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> <br />Section 1. Section 1 of Ordinance No. 1387 of the Code of Ordinances <br /> <br />of the City of La Porte, is hereby amended, to read as follows, to-wit: <br /> <br />JUNKED VEHICLE. Means any motor vehicle as defined in Section 1, <br />of Article 670ld-ll, Vernon's Texas Civil Statutes, as amended, <br />which: <br /> <br />(a) that is inoperative: and <br /> <br />(b) that dOE!S not have lawfully affixed to it either an unexpired <br />license plate or valid motor vehicle safety inspection certi- <br />ficate: that is wrecked, dismantled, partially dismantled, <br />or discarded: or that remains inoperable for a continuous <br />period of more than 45 days. <br /> <br />PERSON. Any individual, firm, partnership, association, corpora- <br />tion, company, or organization of any kind. <br /> <br />DEMOLISHER. Any person whose business is to convert a motor <br />vehicle into processed scrap or scrap metal, or otherwise wreck <br />or dismantle motor vehicles. . <br /> <br />Section 2. <br /> <br />Any person, as defined in Section 1.07 (27) Texas <br /> <br />Penal Code, who shall violate any provision of the ordinance, shall be <br /> <br />deemed guilty of a misdemeanor and upon conviction shall be punished by <br /> <br />a fine not to exceed TWO HUNDRED DOLLARS ($200.00). <br /> <br />Section 3. If any section, sentence, phrase, clause, or any part <br /> <br />of any section, sentence, phrase, or clause, of this ordinance shall, <br /> <br />for any reason, be held invalid, such invalidity shall not affect the <br /> <br />remaining portions of this Ordinance, and it is hereby declared to be <br /> <br />the intention of this City Council to have passed each section, sentence, <br /> <br />phrase or clause, or part thereof, irrespective of the fact that any <br /> <br />other section, sentence, phrase or clause, or part thereof, may be <br /> <br />s:' <br /> <br />declared invalid. <br />
